Title: Is the Benn Act compatible with the Treaty of Venna?
Post by: Rods2 on 13 October 2019, 23:58:17
The Benn Act forces Boris Johnson through threats and coercion to ask for an Article 50 extension with him being threatened with court action, possible contempt proceedings and jail, where he has said he would rather be dead in a ditch than do so.

Watch the 5 minute video and then let us know your thoughts on whether it is compliant with Article 51 of the Treaty of Vienna which is known as the Treaty on treaties.

Apparently not, and has probably let the cat out of the bag as to how we will be leaving on the 31st...

The backstop and Boris,s new version of it are not only incompatible with the Good Friday agreement, its supposedly designed to protect, but tears it up and throws it in the bin. No-one seems to care. We live in a new reality now where the only truth is the one those who shout loudest demand that we believe and adhere to.

I haven't looked at it in detail, but in general treaties are agreements between governments of sovereign nations. In the UK Treaties generally don't need parliament approval to enter effect - the government of the day approves them under Royal Perogative. They only need approving by parliament if they affect a UK subject/citizens rights (viz the Gina Miller verdict). Withdrawl from treaties is often complicated, but ultimately because each country is sovereign in its own right, a country can unilaterally just say it isn't going to comply with the treaty agreements anymore.

In the UK parliament is and always was sovereign. Parliament has passed the Benn Act into domestic Law, and domestic law trumps a treaty domestically.

Anyway, only 6 days to see what's going to happen.

And, taking all of this into consideration, why the hell are we having a queens speech today? If an election is in the offing, there will have to be another one straight after the election. No?  :-\
