Congratulations on the MOT pass  :)
the in-laws have a white Sapphire ,does about 100 miles a year (MOT time) and clogs up the garage the other 364 days  ;D

If, however, the car was leased by TB Bro UK Ltd. Then it's a whole different ball game as B2B is not the same as B2C.
And I suspect there lies the complexities...

According to the website Consumer Rights Expert, all new cars are covered by The Consumer Rights Act 2015 (which replaced The Sale of Goods Act 1979) and this Act states that all new cars should not only be "as described" and "fit for the purpose for which they were bought", but also "of satisfactory quality".
Merc UK, from what I can ascertain, are essentially saying the car is still usable, as the fault is with the climate.  Thus it is absolutely fine to shove their fingers up their arse and do nothing.

Bro is less happy, as he is paying for a LWB S Class with additional options ticked, on a 2 year lease, and for a significant proportion of that he is given a much more affordable CLS.

Yay, unusual to see a Ford or that era in this country.

That must be one of the last Sierras before the Mundano came along.

I can see him losing that argument if he has refused to use 'his' car pending the repair :-\

Sounds like he's dug his heels in and they've gone out of their way with the CLS when they could just as easily given him a base A Class to run around...

It came to a head when that hot weather we had earlier in the summer was predicted, as his dealer up til that point fobbed him off previously (the fault has been ongoing since at least March), and then when he pressed the point that it was gong to be 37C, was given him stupid dates to even book it in to look at it - which leads me to suspect there is a known issue, so they try to delay each stage - so he did drop it off and told them he was leaving it there until they fixed it, as he could foresee it not being fixed before it gets handed back in a little over a year.

I believe the CLS has come from MB UK, not the dealer, but could be wrong.  I did spend a lot of the time laughing as he was recounting the saga. As you would, really.

I rather think the best he might be able to hope for is a claim for the difference in lease costs between a cls and an s, multiplied by the period of time you don't have the car. But only if he's petty or vindictive enough to see it through to the small claims court - I know I would be but then again we are not all the same.

It also doesn't put his ar$e back in the seat of an S-class each morning...

That's the thing, he will be tied to paying the monthlies for the S. The CLS is gratis... Even though it may not immediately feel like it.

That's the thing, he will be tied to paying the monthlies for the S. The CLS is gratis... Even though it may not immediately feel like it.
Hardly. He's paying for a more expensive S-Class, but getting a shitty CLS in its place. Sounds like a bum deal to me.  But he went for a Merc, so sympathy is, to quote Lazydocker, in the dictionary between shit and syphilis.

Changed a fuel pipe again on the Battlebus, due to cracking.

Although once I got it off, it seems the cracks were only surface.


Changed air filter on it whilst I had the think on the drive with the bonnet open.
