Spent the weekend ripping the piss out of big bro, who has been in a courtesy car for a month or more, as his less than 1 year old, £85k, S Class is awaiting parts.

He's just been told by Merc that the parts are due sometime "early 2020" ;D


I know I shouldn't laugh, but I did tell him not to...

I have to say, in his position, I'd have had an absolute meltdown. Unless ofc my hire car was also an S-class, in which case, I'd probably let it go  ;D
He aint best pleased. He has been loaned a CLS as a replacement.

His suggestions to MB Customer Service to pull a part from the production line is, apparently, "impossible".  But he can have a new one, fresh from the line...


...if he stumps up £85k


In these days of anti-social media, a few while posted comments might get the right response, or just phone daily fail or similar.

I believe so, but he's looked at ending it, but can't without significant penalties, as I had suggested that. Not clear exactly why, or if it is a lease/pcp etc.

He's stuck in it and the dealers responsibility is to the leasing company as the vehicle owners... As long as the leasing company are happy to wait, they won't do much to rush.

His only option would be to stop paying in order to force a point, but that will then be a breach of contract and they will screw him for it. Also the leasing company won't care as their obligation is to provide a vehicle as described on the agreement, with zero obligation towards it working... That's Bro's responsibility as he agreed to do all the looking after (regardless of who or how this is done ie service plan or included maintenance) when he signed up... Paying for and looking after the goods will be on him.   :-\

According to the website Consumer Rights Expert, all new cars are covered by The Consumer Rights Act 2015 (which replaced The Sale of Goods Act 1979) and this Act states that all new cars should not only be "as described" and "fit for the purpose for which they were bought", but also "of satisfactory quality".

What does it say about providing repairs in a timely manner, and how is that affected if the warranty provider has provided another car?

The fact that a car is leased/pcp/HP has no bearing on a consumer's right to reject the car under the consumer rights act 2015. If it's more than 30days old, but less then Merc has one chance to fix the car in a reasonable time period and then the consumer has the right to either claim a replacement, or throw it back.

The BMW I rejected was owned by BMW finance UK ltd. I was the registered keeper, which isn't so with a lease car (I've never seen the gold's v5 for instance) but the process is basically the same.

If, however, the car was leased by TB Bro UK Ltd. Then it's a whole different ball game as B2B is not the same as B2C.
