CHAPTER 1
----------
June this year a family member walked into sandicliffe and left with a 11K jeep.(on finance
through santander.) With a 3 month warranty.

http://www.sandicliffe.co.uk/mazda

next day car developed a water leak and was returned to them to be sorted.(which they never sorted)

It was then returned to them for a further 4 times up until early november owing to them not sorting out the problem.

When they were given it back (for the last time) with the interior heater not working(matrix) they

decided to throw the towel in and give the car to a main dealer.

--------------------------------------------------------------------------------
Chapter 2
---------
Once these had got the car and after looking into the fault they said that a product called

super steel had been added to the coolant system, And therefore required a new water

pump/hoses etc along with other components And your looking at £1500 sir.

-----------------------------------------------------------------------
Chapter 3
------------
He returned to sandicliffe to talk about the problem and they pointed out to him that his

warrenty had now expired..And its his bill

That was last friday..

                   THE END
--------------------------------------------------------------------------------

His question to me tonight was" steve ,,do i have to pay this £1500 to them"

My thought are .. How do you deal with this ?

TIA

The Warranty still stands as the fault was reported before the end of the 3 month warranty period.

Get the Finance company involved, they will have a huge amount of clout and Sandcliffe will start to shit themselves when they get a phone call.

Wot 'e sed :y

If the finance company can't help, although they should as they have a vested interest in the car, the speak to your insurers... if you have legal cover in your policy, get them involved...

That said some useful info here...

http://www.which.co.uk/consumer-rights/regulation/sale-of-goods-act which covers retailer responsibility. This doesn't apply to financed good though.

See here... http://www.google.co.uk/url?sa=t&rct=j&q=used%20car%20dealer%20liabilities&source=web&cd=5&ved=0CDMQFjAE&url=http%3A%2F%2Fwww.norfolk.gov.uk%2Fview%2FNCC094699&ei=lYByVJDRAcvLPerwgYAK&usg=AFQjCNFPj34ARbOmw3p1pjQG0oDLQGKEEg&bvm=bv.80185997,d.ZWU

In particular pages 28 and 33. Basically any fault occuring within six months is deemed to be present at time of purchase. Therefore dealer is liable. However, as said, because the car is financed, the dealers contract is with the finance company, not your family member.  This means to get it fixed you must go through the finance company, and fast.

Ring them first thing, then deal via email, so there's a written trail rather than he said/she said :y

Good luck :y

Pleeeeeease let us know the outcome. It's always good to know in case anyone else has a similar problem and, of course, to hear of a dickhead dealer getting his comeuppance.

Latest update on this is:-

Santander Emailed form to Family member Which he filled in And Emailed them back. (wed)

Early this week The car was removed from the (jeep) main dealers by sandicliffe. With No work being carried out on the car.

I think the below email sent to sandicliffe by the main dealer may have something to do with it.

----------------------------------------------------------------------------------------------------------------------------------

From: xxxxxxxxxxxxx [mailto:xxxxx@unityautomotive.co.uk]
Sent: 21 November 2014 09:56
To: xxxxxxxxxx@sandicliffe.co.uk'
Subject: Estimate for repairs on xxxx xxxxx
Importance: High

Hi xxxxx,

We are very conscious this vehicle has been here a number of days now, we really would like it moving back to your premises whilst you await authority on the repair as we are running short of room and do not have a storage facility for vehicles, if you could let me know if this is possible as soon otherwise we may have to start charging storage from Monday 24 Nov.

The vehicle in question has at some time had a “Supersteel” leak stop added into the cooling system, which will cause a problem even with flushing the cooling system out  it will not remove the blockages in the heating system nor cooling system which are present, and other components may start to leak again.  Due to this we cannot guarantee any of our repairs on this vehicle.

The vehicle requires a new water pump, thermostat and complete flushing out of the system. The costs are described below:-

Parts £666.80

Labour £595.00

VAT = £252.36

TOTAL = £1514.16

Please could you get in touch with me today so we can resolve the storage issue on the vehicle whilst waiting for the authority.

Kind Regards

xxxxxxxxxxxx

like this guys style

http://www.dailymail.co.uk/motoring/article-1190340/Rovers-revenge-Furious-driver-dumps-50-000-Range-Rover-outside-showroom--emblazoned-list-faults.html

That is a great idea....... :y :y

One other thing, part of keeping the finance company involved, is that the car could be simply be returned to them if it is on Hire Purchase, the car is still their car until a certain period has elapsed, so wont affect his credit rating.......... :y  This will encourage the company to repair, I had to threaten such action, in relation to a Rover 827 and all was resolved satisfactorily, they even had to return it to me in Hertford where  I was living at the time, the car was purchased in Darlington........ :D :D
