OOOPS!!
« on: 23 June 2018, 08:00:52 »

Got home last night to find a letter from DVLA saying my direct debit for the V70's tax would not be renewed on 1st July if I didn't get an M.o.T. certificate for it,puzzled by this I looked up its paperwork to find that the M.o.T ran out 3 weeks ago :o It doesn't seem anything like a year ago it was tested, why oh why in this day and age of computerisation can no reminders be sent out for this?

Yep, Dot Gov already have your email address if you tax your Car online together with your Bank details, so would kinda make sense to give them your Mob Number as well.

the police may want to know you details too
when they pull you for no MOT (which means NO insurance)
I think ,if DOT GOV wanted my phone number , they'd get it pretty easy
many people "verify " their freindface ,email etc with their phone number (not me )
Plus , Mrs builder is in charge of paying bills  :P

My Vx dealer that I use automatically sends communications about the renewal of my MOT well before it is due ;)

Most garages do (or did, before this new abortion of a law) as obviously they want your business.  It worked for everyone :).  Then the do-gooders and thick people had a brainfart idea to bugger that up.

No doubt they'd be very happy about no MOT but as for no insurance at all ...... If that was the case Plod would pull you over the very moment your MOT expired. When I admitted my misdemeanor to the copper next door, he said that they would only pull you over if your MOT was more than 6 weeks out of date.

In this situation it is effectively uninsured as you have blatantly failed to maintain your vehicle in a roadworthy condition.

ie if you prang it, they won't pay out because you should NOT have been using the vehicle in the first place...  ::)

The only exemption is to/from test or place of repair in relation to said test... And even then I suspect that you will find your cover limited to Third Party only :-\

how does the lack of a piece of paper say that your car is not roadworthy? That's like saying that a MOT certificate is a guarantee that your car IS roadworthy

It is on the day of issue.

Fail to present it for an annual test and use it on the road and you have no way to prove that it has been independently tested according to the legally required standard.

The automatically qualifies it as being of unroadworthy condition. Good luck proving otherwise.  ;)

I think I see where DG is coming from on this,if you're using your car on the road[other than to/from a pre-booked M.o.T.]without such a certificate then at least technically[and most probably legally]your insurance would be invalid.I know the M.o.T. only really means the testable items were passed at the time they were inspected but to all intents and purposes it is taken as being legal for a year-blatantly obvious faults such as bald tyres, worn out brakes, blown bulbs aside of course.Anyway now I know it's run out the problem will be addressed. It just came as a shock that it'd run out as it seems nothing like a year ago that it was last tested.

Likewise when I found out mine had run out  .... I found the same way in that the DVLA website would let me tax it.

The insurance thing is probably a grey area, and given the competitiveness of the industry, they always look out for ways to pay out...

...but I think they would have a hard job fighting it.

That is what the Insurance Ombudsman is for and they will have guidelines known by insurers.
