A43 Accident

On their way to Silverstone a couple of weeks ago to a car show, where my grandson was showing his beloved little car, him and my S-I-L were lucky to escape alive. My grandson was driving, (on L plates) and they came to the usual queue on the A43 for the Silverstone event. Luckily my grandson stopped a way back from the car in front, and thankfully, the woman in the Galaxy behind, had left a long space. A foreign lorry and driver ploughed into the back of the Galaxy behind. That spun, total write-off, into the back of my grandsons car and the momentum concertinaed him into the vehicle in front, which then continued the sequence to about six cars. Grandsons car is a write off as will be the one in front. Can't comment on the others in front. Basically a re-run of that awful accident on the A34 in which people died.
The police commended my grandson and the woman for leaving space, as they said, had they not, it could have been dead bodies being pulled out of the wreckage.
A witness stated the lorry was weaving over the dual carriage well prior to the accident, and said he (witness) was blowing his horn at him, behind, and flashing lights. It then went into the nearside lane, continuing at speed, despite the huge yellow signs stating through traffic to the right, Silverstone keep nearside and ploughed into the stationary traffic. The witness stated that when the lorry went into the nearside lane, he overtook, and said it looked like the driver was asleep or nodding off.
This seems to be confirmed by the driver, who also played the 'not understand english' card I assume, when questioned about the massive yellow board instructions !!!!!
Luckily, there were no major injuries, as far as I know, grandson is being treated for back injury by the doctor. Woman behind went into shock, and threw a wobbly about 'if her little girls had been in the back, they would be dead.'

Question we are asking....will that driver be prosecuted for anything !!!!! >:(

No one will be prosecuted, in much the same way as the Lorry driver who drove into the back of one of my Omega's and wrote it off when we were sat stationary (with foot on brake) due to the motorway being closed.....

How do you not see miles of flashing warning signs that say 'Lane 2 and 3 closed' and 'Motorway closed after next exit' and a row of vehicles with their brake lights lit up in lane 1?

On the upside I think he managed to read / post whatever he needed too on Facebook / Twitter / Grindr or whatever he was looking at.

That's a real shame, he put a lot of work into that car and won't get a decent payout and now has a history which will make insurance ridiculously expensive  :(

Yes, that's right, Dave. Of course, you saw it at the  Brackley meet. Since then, he put it in a Classic car show and won best of era with it.
As you say, 'no fault' means nothing to these money grabbing insurance companies.

Strange thing though. When D-i-L phoned the insurance company, they put her through to the claims dept, who offered her to go through insurance, and losing excess, etc, or go with them ? no fault specialists, keep the excess, etc, on a no win no fee basis, but 25% fee if won. Like 'Accident Lawyers for You'.
Never heard that from an insurance company before !!!!

That is exactly the same experience we had and, if the specialist company is called "Auxillis" then they are about as useful as a chocolate teapot. Granted, yours sounds like a write-off situation, but it took several weeks for us just to get the repairers to talk to Auxilis instead of:

Call Auxilis: "We are waiting for engineers report"
Call repairers: "We are waiting for authorisation to proceed"
Auxilis: "We can't authorise without pictures of the area to be repaired prepped for paint"
Repairers: "We can't prep for paint without authorisation!"
Rinse, repeat, for two weeks or more..

Anyway - sorry to hear of the accident, hope there are no lasting effects for anyone.

That is a horrific story.

I am sure I am not alone in taking care when confronted by stationary vehicles ahead. Leaving gap, slowing down the vehicles behind, having an escape route but no matter how careful you are a rogue 30 plus tons lorry with a dozing driver is always going to be an issue.  More grist to the case for autonomous  vehicles. Or at least driver aids like lane assist , vehicle nterval.

Glad that they're fundamentally OK, however nice, that isn't a car to be in for that sort of prang...

If the truck is UK registered then it should be easy enough to identify their insurers and pursue them directly. This should also be true of foreign registered vehicles although it may well be easier to run it through your insurers and let them do the leg work.

All that said, your (gs) claim is directly against the Galaxy that hit him, so start there. Absolutely no point running it through a management company only for them to take 25% off what you would otherwise receive  ;)

My back is still fairly 'dangle berries'ed from where I took it up the arse in 2012, almost 8 years ago.

Its horrible, but I think everyone needs a significant shunt to show them how vulnerable you are in a small tin can.  At least nobody was life-changingly hurt :)

Glad to know that Tony's grandson was Ok, and indeed no one was seriously injured :y :y.

I myself had one shunt from the rear, and another incident when, but for a second of pure good fortune, I could have been well written off!  Watching in your rear view mirror as a 20+ ton, fully loaded with gravel, rigid 8 wheel lorry coming towards your rear at speed, with screaming, squealing, brakes down a hill when you're stationery, is something I never want to experience again! :o :o :o

I can just imagine what Tony's grandson saw in his rear view mirror and know there is nothing you can do about it, which is the worst part about it! :o

Very glad to hear all are physically 'ok' and nothing more serious. I hope some justice comes, but don't base your own sanity on it, as I know from personal experience. Whether he's prosecuted and later killed in prison, or he gets off scot free and wins the euromillions a week later don't let it eat you/your family up, just put it behind you and move on best you can.  :( Everyone's alive which is the main thing.
