Question for the builders...
« on: 09 October 2016, 18:10:06 »

Do you need planning permission for an extended fence, same height as current one (6ft) if:

1) It marks no boundary to a property, other than mine. Side this fence is, it's only to a road, no other house.
2) It's only boundary is to a private road, not council funded (and there for not a highway?  :-\)
    - Council has not adapoted the road, with no plans for it either. (no street lighting etc)
3) The fence is within my land as indicated on council sourced mapping and maps provided with deeds of the property.
4) It has no impact of light/sight or any other kind of impact to any other house in the close.
5) Agreed with Management Company of the Private estate.

I'm not sure, as here:

https://www.planningportal.co.uk/info/200130/common_projects/20/fences_gates_and_garden_walls

It suggests it's only needed if it's next to a 'highway' - As it's private land and private road, I'm not sure if that counts?  :-\ :-\

- Stand by for posts on how to build a fence  :D  ;D

Should add been discussing this with neighbour directly behind me, as we both want to do this as it will mean more space for us both. We extend both of our fences closer to the road, giving some much needed storage room.  :)

It depends who owns the land the new boundary will encompass. But in principle I agree with BG. :y

This has always been my approach to sexual opportunity. :y It hasn't always ended well. :-\

As for the fence I can't really see a problem. Having said that anything to do with 'boundaries' can be contentious.

The management company of the close, of which all residents are members.  :)

I can't advise on your particular situation, because no two are exactly the same. But, if you have spoken to your neighbors, and none of them object, I would certainly go ahead. It's not as if it's an extension that could end up costing you £000's to erect and demolish, it's a fence and, if the worst were to happen, I doubt it would bankrupt you.

End of the day in this type of scenario, its normally the Neighbors that complain and start the ball rolling, so if there sweet just do it.  ;)

Are you D.Trump? He has the same cavalier attitude to women. Surprised you didn't advise the OP to get the neighbour(over the road) to pay for and build the fence. ;D ;D

Some of my fences are restricted to 3' on and adjacent to the front boundary as a covenant in my deeds, so maybe worth checking yours for any restrictions.

Indeed, many local restrictions limit fence height to 900mm on the front of a property (be it an adopted or un-adopted road) and some don't allow any fencing.

So worth checking the bylaws.

Thanks I'll check. It's the side of the house if that matters, only visible from down the private road.

This estate consists of various parts, all  'open' areas being under the control of a Management Committee. All properties have their boundaries, and anyone wishing to extend onto these areas, apart from planning permission, have to get permission from the Management Committee. Indeed, in the past, some residents have encroached with fences, and have had to remove them. Also, in this road, years ago, one family received planning permission for a kitchen extension, ordered bricks, which were stacked on the front lawn, only to be told permission for the extension was denied by the Management Committee, due to it coming forward onto 'open' areas.  :)

Don't know what covenants you have signed (if any), but imo, worth checking, just in case someone objects :y
Sorry to sound pessimistic, mate, but that's what happens here :(

Although nearby you are in a different district to me.  I know that the planning dept at Rushmoor are fantastic and very helpful.  Maybe worth a quick call with your local planning office to discuss your intentions?
