Debt not paid.

Hi all, ordered a part off the net from used vauxhall dealer, sent the wrong part (their fault) I returned it  and they sent the right one, since then I have not received my refund now going on 5 months.
Phone calls emails no response its under £50.00 is court an option or what your help would be appreciated, thank you for your time!

I don't understand.  If they corrected their mistake by sending you the correct part, why are you entitled to a refund?  :-\

Possibly had to pay twice, once at each order... first item should be refunded either as a return of payment or as a credit note against the second :-\

Does depend on the circumstances though...

If you ordered a facelift Omega bonnet and a prefacelift one arrived, that's not your problem... if however you ring and ask for five of those clips that hold the wheel arch liner on, then the onus is on you to know what your ordering.

Sorry, I sent back the wrong one and then he sent the replacement which I paid for, but has not refunded to me the cost of the returned item plus postage. Thanks for your input all.

If you have proof that you paid and never got a refund (provided he agrees that he received the returned item) then you need to send a registered letter asking for said refund and giving him a reasonable amount of time to pay. If you've heard nothing after this time then you need to write again threatening legal action.
If he says he hasn't had it back and you have proof of postage then your beef is with the carrier.
If he says he hasn't had it back and you have no proof of postage, I guess you're stuffed.

 :-\ Seems a daft way of going about it, paying for a second item, which, presumably, cost the same as the first wrong item. Why didn't they just say 'send us the old, and we'll send you the new one'..why pay twice? Then again, my uncle rang the council about a query, because he was owed something like £78.12 wages by the council, and it turns out he also had an outstanding debt of, say £78.19. So he said, 'oh well, that's sorted, then, yes?' to which they said 'oh, no we need you to pay what you owe us now, in full, and we will send the outstanding £78.12p balance we owe you in the next 5-10 working days blah blah' all that admin and time complete waste of time for a literal few pence.

 I have proof of postage and a receipt for the first wrong item sent for which he still owes me the money. I have sent an email giving him 14 days to to pay or will go to Police, Trading Standards, and Vauxhall forums. At no time has he said he received the returned item or not, I have no correspondence from him whatsoever, I have sent him numerous emails and made many phone calls. Is there any point taking him to court because the cost would be greater than the debt?

To be honest the threat of legal action, small claims court etc will generally be enough to put the willies up someone. Hope it works out ok.  :)
