Very annoyed, here's the story;
8.17 this morning put some Diesel is the Range Rover. Exited Sainsbury's and approached Kidlington round about (non traffic light.) Entered the RA (8.21)in the inside lane (nearest the grass of the RA) then approaching second entrance to the RA, black Saab 93 approaching and then entered the RA and went striahgt into my lane right infront of me. Jumped on the brakes, could feel the cadence of the ABS kicking in, but hit his O/S rear with the N/S front of the RR. Travelling at about 26 MPH. Bumper of mine came off damage to wing etc. He then gets out and says...why have you driven into me? So I asked if we was ok first. Then if he knew how RA's worked? You give way to the right. I simply could not have done anything else, couldn't have swerved as the ra was busy with other vehicles.
Why the hell did he just pull out, he can't claim to not have seen me???
My RR then didn't start, later found out it was a safety feature cutting off fuel. Called Police, and exchanged ins details, police were in attendance approx 5 mins after call.
I have the sneaky feeling he's not going to admit liability, even though clearly I think it's his fault.
I was in the correct lane, signalling correctly and he just pulled out.
Phoned my insurance company...what else can I do?
The most annoying thing is the RR was due to be sold today, had a viewing this afternoon, which clearly can't go ahead now.

Make sure you have witnesses, as I suspect he will find some.
I found out to my cost that some people are usinf friends and family to become independant witnesses even though they where not there. It is sneaky and underhanded and probably illegal, but be assured they will do it to you.

It was done to me by a driver who drove off from the scene of accident, says because had children in car, contacted police, few days later they had two independant witnesses.

sorry to hear this Josh, its a lovely looking rangie too  :(

I would take a camera back, and take loads of photos of the offending aroundabout.

Then annotate them with your location, where he was, and where the impact was. Try (not getting run over) taking pictures on the roundabout where you were position and such.

Did you manage to get the details of any witnesses?

Josh, you were in the right, he should give way to oncoming vehicles, thing is, at that time of the morning, everyone's Jenson Button, but in sleepy mode, did you take any pics at the scene?

Scan for CCTV on premises or street installations overlooking the scene.  Should you find some why not ask for sight of any images recorded.

I hope you are OK Josh. As someone one told me they are only metal boxes and can be repaired, not the same and certainly not what you want to hear right now. My condolences, but do me a favour do not take the MV6 out.

Regarding witnesses, no one wanted to stop or help. I was suprised, I asked two people, and they both said sorry, don't want to get involved.
I had a can of yellow chalk paint in the boot, so marked the position of my front wheels, with his back wheels on the road surface.
Unfortunately no CCTV  :(
And sods law, I have a box full of emergency break done gear and a digital camera I transfer between all vehicles I drive...but the batteries were flat...won't make that mistake again  ;D
And killing him might have be a good option  ::)

That is a sickener.  As said get all the evidence you can esp CCTV if possible (may have to cross some palms as I don't think they're obliged to give it).  Try and do it before the TP can scupper any.  Good quality pictures down the line of your travel and his and trace the road layout off Google Earth etc.

If he denies then you could be in for a long haul so may need to get your RR fixed at your own expense as you want to sell it.

Only deal with your insurer don't touch his insurer or negotiate with him unless you know the FULL cost of repairs and he gives you cash to cover it.

My blatantly obvious no-fault rear-ender happened 1/7/2009 and paid out 19/12/2009 after Small Claims Court process.  You don't want to wait that long so make your evidence irrefutable.

Sorry to hear of your accident mate, especially when you were about to sell your car  >:(

The rules for roundabouts are pretty much black and white IMO, if somebody pulls out onto the roundabout when you are already on it, then they are automatically at fault. It's good that you had the presence of mind to mark the position of the vehicles, but this may count for nothing if you don't have witnesses

I just wonder how the other driver will cover himself regarding his side of the story and how the insurance company will deal with it? May be worth conjuring up a few 'witnesses' yourself, as mantahatch mentioned

Sad news Josh, can I ask, was the guy a foreign national by any chance? Expect the passengers to multiply and all of them having whiplash!

Same sort of thing happened to me years ago.  Clown ran into side of my car on roundabout - had to be his fault.  No observable damage to the elderly tank I was driving, but his Escort sort of fell apart.  Gave him my insurance details and left him to it.  Couple of weeks later, get a letter from his insurers blaming me, and naming some witnesses.

Funny thing was that the crash happened on the Shepherds Bush roundabout, and the other bloke came from the Isle of Wight, as did all his witnesses.  I pointed this out to my insurers, and I never heard anything more. :) :) :)
