All I know is that back in November last year, when my 2.5 was written off, my insurance company gave me the choice of a cheque for the full value of the car (which I accepted) or the car back with a cheque for 60% of its value.

No auction involved. ;) ;)

Until you've accepted a payout from your insurance company the car is still yours so you can do what you like with it. :y

Having said that, if they have officially written it off there's a procedure to follow, depending on category, before you can legally put it back on the road.

Cat D - No VIC required.
Cat C - VIC required, cam be put back on the road if repair satisfactory.
Cat B - Some parts maybe salvaged from the car, never to be put on the road again
Cat A - Everything is only fit for the crusher

I'm just going through this with my 03 plate omega and i was told i could keep the car by the guy who come to look at damage but when i called the insurance to say that i was keeping the car they said no and that it was all to do with getting older cars off the road but yes i could get it back if i was to go to the auction >:(

Totally illogical... if it's keeping older cars offf the road .. it would be scrapped .. if it's for sale at an auction .. it's back on the road.

Methinks someone is talking out of their backside. ... and I'd be telling them just that.

I know and i said that i was only going to use it for parts so i would send them the V5 but i was then told that i may be selling the parts which would only be keeping other cars on the road and it's the gov that have set out this guide line about not letting the owner keep there car, all i seem to be doing is banging my head >:(
