As it said no visible damage , I would ask for a refund. The only thing is you will incur P&P costs

and as the postage is almost the exact cost of item i'm still out of pocket - hence the name and shame campaign ;)

Ebay can not be trusted, you take a risk.
But i like to think that members of OOF would describe accurately.
Really would like to hear both sides of the story.

;) May I please inquire as to the total cost (incl. P & P) you paid for this item? ;)

I am not sure the part sent was the same as that pictured in the eBay ad.

Could be a simple error in that the wrong one ( if seller has lots of parts lying around) was sent.

Best bet would be to contact seller, explain your concerns and see what response you get.

OK I am going to state my opinion.

They had more than one and sent you the wrong one!

Having had the opportunity to review the eBay item-listing; it would seem the item dispatched may not be the one described/pictured in the listing and as such; a genuine error is always a possibility.

Given the above, then the seller should be offered (and take advantage-of) the opportunity to refund or replace (at their expense); if he/she does not take that opportunity then escalation to dispute with eBay would surely be the way to go.

It`s a shame to observe that the seller took the opportunity for a 'knee-jerk' reply to your purely statemental feedback, an action in the heat of the moment which has done him/her no favours. :(

to be fair we'd had a 2 email each conversation prior to this feedback which started :

"Hi Mark

Package arrived today very well wrapped - but when i opened it i was shocked to see the condition off it, it is very rusty and bent/dented with obvious crash damage. You described this item as quote "EXCELLENT CLEAN EXAMPLE REMOVED FROM A FULL RUNNING OMEGA 2.5 V6
NO VISABLE DAMAGE!" this is not true.

I don't want to get shirty but i expect a full refund (including postage) for an item which is clearly not as described and frankly fit fot the bin.

Yours disapointedly

Jake"

which some may find harsh offensive? (another poll ?) but i thought was curt and to the point particularly when the seller was someone i thought i could trust ::)

to which they replied:

"im stunned at your response - we have now sold several of these - there an exterior item not rust protected and as photographed...."

 :-?

Title: Re: Ebay advert v Truth - What do you think?

to which i replied & attached the above 4 photos

"Mark,

With all due respect, your "as photographed" is not the item i have received as i had to wait for you to remove it before posting.
I've attached some photos showing the condition of the offending item - it has been in some kind of prang at the right hand end and is no where near square and as such i will not be able to fit it.

I bought this item in good faith based on your description :

EXCELLENT CLEAN EXAMPLE REMOVED FROM A FULL RUNNING OMEGA 2.5 V6
 NO VISABLE DAMAGE!

This simply isn't true, i don't want to start leaving negative feedback and going through all that business, but be fair the item you have sent is in terrible condition.

I hope we can resolve this issue with no hard feelings.

regards

Jake"

and the final response....................

"Jake i am not going to get involved, i am very very angry at the tone and insinuations used in your original communication, if you feel this is an accident damaged and significantly different then i suggest you proceed via ebay and paypal on that basis - i dont feel you effectivley communicated iniitally and i will let ebay sort this out.

Item was sold as seen and this is not a cosmetic item that needs to be pristine. There is nothing wrong with this item that would impact safety. I am deeply disturbed about your accusation that this is accident damaged.

I dont appreciate messages that mention" i dont want to get shirty" and "i dont want to leave negative feedback" this is an implied threat and is also feedback extorition ( http://pages.ebay.co.uk/help/policies/feedback-extortion.html ).

Again i am very angry at your comments and will leave the communication as is. In line with ebay policies if you want to return we will refund, we will NOT pay for return postage however."

WTF???

he's angry? >:(

whoever it is needs a reality re-adjustment and a bloody good telling off.

that is SO not what they advertised.

Absolutley Stunned!

Okay lets call this "right to reply"  >:(

I have had to advise this individual to go through the proper process to claim a refund - which he refuses to do.

I have already offered via paypal to refund but had no response.

I have had 1 negative in a year and over 500 positive feedbacks in that time. Anyone wanting to be impartial to the sellers lies should look at my feedback

I have been intimidated and threatened over email by this individial and forwarded the threats on to ebay. As ever they will probably do nothing as sellers are blackmailed by buyers.

This is why i have told the seller to stop communicating with me if he cant communicate in an adult way and non abusive way.

I frankly despute that this item is the same one and hence why i want it back.

Maybe i should also wash my dirty linen in public by publishing your emails. What do you think ? No sory not doing that i have more class.

Also intresting that the "buyer" has choosen to involve a medium that was never involved for the orginal transaction ( ie oof) and futher concerning he decides to do this for exposure when there are no admins on the correct the error of his ways.

Yep there is indeed two sides to every story and this is frankly a horrible threatening little man to deal with.

I wont be adding to this comment.
EDIT

Looking at the terminology used i will be taking further advice on how best to legally deal with this individual and some of the comments. I suggest there are no further comments added.

Herefordelite and Markie.

This item was not advertised for sale through OOF and has no relevance here other than enquiring as to what others think should should be done by the original poster.

Both sides of the matter gave been aired and, as the sale was conducted through e-bay, I suggest to both parties that this is the medium the matter should be resolved by.

I am now locking this thread and will delete the poll as, frankly, I feel that this is not the place for such matters to be resolved, all circumstances considered.
