A parasite parking company by the name of 'Parking eye car park management' are demanding £70 for a 19 minute overstay.
Where do I stand legally, chaps?

That sounds rather excessive given the overstay.
Never fought one of these before. However I do know they should issue the notice within 14 days of the "offence" - worth checking as a first port of call. Also, the article below should give you a good amount of info, both on the company and the steps to take if you want to fight the ticket.

Private car parking companies make me puke.
Most of the 'owners' of these dubious organisations are far from being angels. I believe a spell behind bars is the only qualification needed to set up a private parking company.
Anyway...this one is really legitimate because according to the letterhead Parking Eye are members of the BPA...The British Parking Association and also members of some spurious organisation called the HPC or Healthcare Parking Charter. I mean, what the f*ck is that? :(

Depends if you feel it is a justifiable amount to pay. I'd be writing a letter to Aldi Customer Relations with proof of your (Mrs) shop on that day (a receipt) and a copy of the 'fine'. Write to Parking Eye and aknowledge you have received their corespondance and will be dealing with it in due course. Explain in the letter that you are dealing direct with their customer (Aldi).

I've been strongarmed into writing several letters to the council for a mate, when his wife had overstayed in a car park, explaining that this is a first offence, and in the circumstances, due to a large amount of valuable in the car, and advised by the police not to leave them unattended and so on and so on, and about 2.3 times he's got off with it. Worth writing a letter explaining this, and potentially another to Aldi themselves, even suggesting that this kind of action would cause them to not shop there again, causing lack of custom, and pad press etc... if Aldi use these people to 'police' their car parks, they must be aware that they could be driving customers away. That might get their attention.

I have just tried to contact these cowboys by telephone. This has proved impossible.
The only telephone number they provide is to pay fines via an automated credit or debit card system.
A multi million pound company without a single customer service representative. >:( >:( :(

Myself & swmbo have been the victim of the 'Double Dip' phenomena mentioned in that link from Jimmy, not one or twice but SEVEN times, always at our local ASDA store and from Parking Eye! We argued that the cameras must be faulty, Operator error etc, etc but each time ASDA refuted this although they did get the tickets cancelled after the third occassion in only two weeks! When they still kept coming, I asked for my complaint to be escalated to ASDA Head Office and threatened to sue them for harassment and distress as they employ Parking Eye as a Direct Agent. Suprisingly we have had no further trouble since ;D
My advice would be DO NOT engage with Parking Eye in any way until after approaching the Manager of the store involved and taking the matter up with them and their Head Office if necessary. Do not be fobbed off with excuses such as ' we have nothing to do with the Parking Company', or 'There is nothing we can do you must take it up with the Parking Company directly', this is BS, but you must be willing to stand your ground and let the Supermarket know you hold them responsible for the predicament you find yourself in and expect them to solve it! About a month ago went into Aldi Bought something Then left the shop After typing my Reg into there system instore.
Week later a fine came through the door. Saying my vehicle had used the car park illegally.
This happened owing to me putting the wrong Reg in there instore computer thing.
I rang Aldi and told them about the fine and that i still had my reciept to prove i used the store,She told me its nothing to do with them and to deal with Parking eye car park management,Online.
Went online and sent them a copy of the reciept And 5 days later got a reply saying the end of the matter.
The cameras take your reg pic on the way in & out.

Have a read of moneysavingexpert, there's a massive section on it there but don't bin it or ignore it you only have about 30 days to appeal and there are pre written letters on there :y

I would say this is a bad plan. Its likely to lead to the addition of admin fees, passing of debt to debt collector, then potentially (depending on the debt collection agency) a CCJ and bailiffs, in that order.
When I've been charged for something I believe is unfair/unjustifiable I typically pay the amount and then fight to get it back. This then prevents the aforementioned harassment and other associated problems (damage to credit rating etc). Of course that only works if the payment of the amount in question and the costs to get it back doesn't put you in financial difficulties - I am fortunate in that it never has.
In this instance, given the (relatively large) fine and (relatively small) overstay, combined with the mitigating circumstance that the OP's wife was actually using the store, I would take the case to POPLA on "genuine pre-estimate of loss" grounds. Although something in the back of my mind makes me think a big case is going through the supreme court ATM on that very issue. Some googling would probably be useful.
In the second instance, I'd go to Aldi for an ex-gratia payment, given the amount you could probably get it back from them just by threatening to take them to the county court for it. Even if your reasons were spurious you could probably get it off them because the company cannot afford to defend a claim for £70. Their solicitors probably bill out at about twice that amount - per hour.

The whole issue is they can only pursue you for loss of earnings due to your parking on their property, the penalty they request in law must be proportional to the loss, hence, i believe no one has ever been successfully prosecuted in court. How could they justify £70 odd loss for 19 minutes parking or whatever?

Did none of you watch Watchdog a week or so ago. They sent in a reporter with hidden camera.
To cut a long story short, the company said they do not take people to court, its to expensive !!!!!!

you have to argue that the fine does not constitute fair compensation for the overstay and thus is invalid. Don't ignore it but follow the procedure in the links provided :y

I would agree with this. Sticky fingers on the screen at the end of the day often end in poor letter recognition.

They will almost certainly not accept this so I shall then move on to POPLA and see if they have any clout.
I have also contacted Aldi and told them that we will not shop there in the future if they insist on employing cowboys. I hope to hear back from them (Aldi) but will not hold my breath.

From Aldi PoV, you will likely get better traction if you post it publicly on their Facebook or Twitter feeds. Give em a chance to respond via email though.

my mate always parks in these places now as his number plates are held on with Velcro and he has some false plates in the boot.parks switches plates and now has about 10tickets
he reckons that because hes on private land hes not breaking the law and because we dont have a tax disc no more they cant tel!l

Going equipped is my starter for ten, closely followed by intent to deceive and finished with a driving without valid insurance/otherwise in accordance combo charge... Private property it may well be, but it is private property to which the public have unimpeded access and therefore considered Public highway wrt the Road Traffic act...

Well......for a start....he's defrauding a legitimate business.....also possibly using someone else's reg number. If someone drives into him in the car park, and details have to be exchanged, I'm sure his ins co would love the fact that he was on false plates at the time.

My sister fell foul of parking eye just over a year ago and received an £80 fine. She was aware of the rules changing in 2012 so she sent them £10 with an accompanying letter.
It said something along the lines of:
'I have sent £10 as a goodwill gesture and as a final settlement of this parking dispute. If it is accepted, I will consider this matter closed but, if it is not accepted, as a matter of principle I will take this matter all the way to court'.
She has heard nothing for over a year now, so was she just lucky or would they prefer not to go to court as it's difficult for them to claim costs back? :-\

They have 6 years to get her. Don't be surprised if they start chasing in 5 years time.
The people suggesting moneysavingexpert and pepipoo are correct. The people saying ignore it are asking for trouble. Avoid ALL contact with them by phone/email - several of the defence methods rely on not telling them who was driving and saying/writing the wrong thing can scupper you. Follow the tried and tested routes on pepipoo/moneysavingexpert and you won't have to pay a penny, plus you'll cost them money.

Worse, if you put something like "My wife was driving and parked in ....", you've told them who was driving - which is who is potentially liable for the charge.
This is not a criminal case - its civil. The standard of proof is "on the balance of probabilities", not "beyond reasonable doubt".

Some do, some don't. Depends if she was ticketed at the time. But they now have the good Doctors email address, and if the email was worded wrongly they may now know the driver as well. They won't be interested in mitigation, and it's even possible they may not consider it an appeal and not issue a POPLA code.

We currently have a court date to attend re a parking charge from 5+ years ago,although general concensus on various forums is the Company wont pay the court application fee intime,take it to the 11th hour, and it will be thrown out ,although we will attend on the day if we are advised day before the hearing it is still happening.
Will be interesting to see what the outcome is as we have a strong defence and their case is full of errors/corrections and in consistancies.

Date of court hearing set for mid October which is quite funny really as first court pares were received in February ,so wheels of justice grind very slowly.
We were offered arbirtaion but declined as case is so P poor we have little to argue against IMHO.
Do find it odd that all court papers etc are just sent out std 2nd class post without any proof of receipt so does make you wonder if you could argue the case that nothing was ever received if you failed to attend and judgement went against you.

Hi Opti,HTH.I have had 11 tickets from parking eye.I go to Birmingham every two months to see friends and family.I stay at the days inn corley m6 north,this is a welcome break services.You get free parking when you stay over night,it states this when booking.But despite me putting the car reg in to the terminal in the hotel,i kept getting tickets.When i spoke to the manageress she said it happens all the time,and said she can get them cancelled.I asked how as like you i could not get in contact,with parking eye.She told me she gets in contact with welcome break,who have a number for parking eye.(we cant get it)Tells them i was a guest and sends a copy of my receipt,tickets cancelled.She has now put me down as staff,so no more tickets.She told me that whoever employs parking eye in this case welcome break,have private contact numbers for them.And as long as you have been using there car park legitimately,they can get the tickets cancelled.Go to Aldi personally speak to the manager,this has probably happened before.They can get it cancelled its just getting them to be arsed.Dean :y

I have made an 'appeal' to these cowboys by email. They have 14 days to get back to me and no doubt tell me that my appeal has been rejected. :(
Then I shall go to POPLA......who I hope are independent of the BPA.

Opti,opps the appeal.Go and see the manager at Aldi,tell him/her i am a good and honest customer.I said this to the manager at days inn,and if you don't want my custom on a regular basis no problem i will go elsewhere.They employ these people.They are responsible for there actions.You were parked legitimately doing shopping,end of.No store,hotel,or company needs bad publicity.Badger the shit out of Aldi,they will repent.Regards Dean.PS as you may have noticed this kind of thing pisses me off. >:(

I got a fine-complete with picture of car-as the registered keeper last year.I'd gone to the local Gala bingo to pick up granddaughter but car details weren't logged into Galas system so I got fine sent,I was on their car park less than 10mins in total!The following week granddaughter took paperwork to bingo with her explained situation told Gala if they didn't sort it she'd not only stop going but also spread the word about it on facebook.Gala had the fine quashed basically there and then.I even received a letter of apology!

I think removing fuse18 in the fusebox of the Omega stops it from starting (not sure, you'd better ask that DTM fella) , be worth doing when Lady Opti is thinking of going shopping again :y
