Title: F$@K!NG Dealers!!!!

AAARRRGGGHHHHHHHH!!!
Do dealers think they exist in a different universe & can just use/ignore the law to suit themselves

Just had another run in with my local dealer.
The story goes in febuary I bought a new crank sensor. I paid full retail because, at the time, I didn't have the TC. It cost £65.80 inc vat.

In april the car started misbehaving again. Paperclip test showed the crank sensor again. So I bought another, this time on the TC £48.74 inc vat and started a warranty claim.
I have waited from April to now for a refund, only to be told today that they will refund the £48.74.
My point however is that they should be refunding the original cost as that is the faulty item that the invoice & my bill of sale with them relates to and the fact I have had to buy two items means I have two separate bills of sale & therefore two different warranties
Their point is that the warranty is with the original part, therefore they only need to refund the cost of the replacement.

Does anybody else here have a better understanding of these issues before I start writing a nasty letter??

Pretty certain they have to refund the cost you paid when you bought it.

I believe after a certain period of time a dealer can offer a replacement or refund at their discression I'm not sure what that time frame is though. It's to stop members of the public demanding a full refund 11 months into a 12 month warranty.

I would still have thought that if they are offering you the choice and you choose refund then it shold be for the cost of the original item and not a replacement.

The sale of goods act will have it covered but it's a long winded document and not written to be easily understood!

 get the bank to do get the money back for you

You paid £65.80 surely they should refund you £65.80.

yes if you used your credit card demand your credit card company perform a "Charge Back"

.. I'm not so sure.   I think after several months they are entitled to offer a replacement (or repair), rather than a refund, so presumably they are effectively offerring you the second one as a replacement and refunding what you paid for that.

The alternative is that they offer you yet another part (which I assume you don't want).

Worth a go on the basis of customer relations, but I am not sure you will get anywhere :'(

Regardless of legalities, which ever they refund you are not out of pocket.

If you accept the lower amount it is surely the same as if the original one didnt fail?

Get your full money back they are just trying it on. Speak to the Manager or Head office >:(

I agree. I would just be glad to put it behind me and take the refund. I'm sure that you feel, in principle, that you are right, but I'm also sure that they will say that they replaced a faulty part with a good one. Is it worth the hassle?

I agree. I would just be glad to put it behind me and take the refund. I'm sure that you feel, in principle, that you are right, but I'm also sure that they will say that they replaced a faulty part with a good one. Is it worth the hassle?
Thats the thing - the claim is one the first part, not the second.  Why would they try and give you TC refund on a non-TC supplied part?  I've found that going in and asking for the head office phone number, then phoning it whilst standing at the counter sometimes produces results - don't forget to ask the name of the chap on the counter as you're dialing...

Ah...good point...but neither are they, though...

They dont want your goodwill...........they want your money ;D
In that case, it can be taken elsewhere ;) ...after the full refund (back to the OP)

Once read about a guy who got so p****d off with there attitude he  went in the showroom one day and said he fancied a new model sat in a couple asked if he could turn the engine over then proceeded to put it in gear rev & smashed into another car , just apologised & left !!
they didnt get him to pay anything !! :y
