Checking V828 prior to MOT, I notice a rattling from n/s catalytic converter. If it passes the emission test, will it pass its MOT in this condition?.

If it's leak free and meets the emission requirements, then it should be a clean pass ;)

Would be worth checking if the rattle is from the inside of the cat or the heatshields, which do start to come loose eventually. Sometimes a jubilee clip round them, or similar, will quieten them.

But yes, MOT criteria are that it's free of leaks, securely mounted and passes the emissions checks.
