Is a non opening tailgate an MoT failure?

Assuming your spare is in the boot, then yes because the tester needs to check the spare wheel? ???

Spare wheel and Tyre are not part of the test
" You only need to inspect the road wheels fitted to the vehicle at the time of the inspection. If you notice a defect on a spare wheel, you should tell the vehicle presenter about it"
as for a boot lid "Load space doors must be able to be secured in the closed position."
as per section 6.3.2

pretty sure they can't insist on looking at the bodies in the boot if it's locked :D

Secured closed is the issue. :D It intermittently won't open...
Best guess is failed electromechanical mechanism or damaged wire. Which is nice.

Ask the tester before the test .... see what he says :-\
I once presented a Smart car for test without the passenger seat (I was leak searching) .... I told him before the test, he asked why & if the seat was going to be replaced at some time, it was & he tested the car - it passed

secured closed poses no danger ,not able to be securely closed ,boot opening randomly at speed does
but as Andy says "ask the tester"
some MOT criteria is open to interpretation ,along with some NTs (testers) not reading or understanding the manual :-X
