It is NOT an automatic ban. There would need to be mitgating circumstances of why you should not be banned however.

Retest is only if ordered by the magistate. In exception cases and extended retest is required. In the case of totting up, a retest is not normally required.

well thats a bit of good news

A bloke at work, who already had 9 points, was given another 8 or 9 but still kept his license and was allowed to continue driving because it would have caused undue hardship for him to get to work without a license. I always thought that was the point of giving a ban!  :-/

If he drives for his profession, use that as mitigating circumstances stating that his children will starve if he's unemployed due to this etc :-/   Alternatevely, slow down :-?

They'd never get me in my van, work isn't worth getting busted for, now in my Meega they could [smiley=evil.gif] Gatso detector and all :-X :-[

the way i see it, they can play it 1 of 2 ways. they can let me keep my lisence and giv me a hefty fine OR they can take my lisence, i will wind my bussiness up, go on the dole and get my rent, council tax, school meals, prescriptions etc etc as well as claim for tax credits and every other benefit, credit, allowance i can get my hands on.

I was still driving on 14 points, when I got caught again and I said that if I couldnt drive I'd be unemployed due to the location of my work and the costs the reply was that I should have thought about that before speeding, and if it was going to cause such hardship I wouldnt be speeding.

In the end I was banned for 28 days, and in hindsight it was better than any points - especially when I was expecting a ban for 2+ years for totting up and the original speeding offence! As an added bonus after the ban my insurance went down as although I have to declare the points and a ban I have a clean licence again.

for advice have a look on http://www.pepipoo.com/

Once had 17 points on my license but avoided a ban because 9 of them (3 bald tyres) came from the same arrest. In that case, only the biggest one counts for totting up.

So I actually had 11 points adding up for the ban.

This is important because you may have points that lump together like this.

Sorry then Kris but it is likely you are facing a ban. 11 points OK, 12 points not.

May be worth talking to a solicitor?

did you get stopped for speeding or was it a letter through the post?

If it was a letter through the post  you are required by law to fill in the form  so do that   just dont sign it and return it to them unsigned
my brother done that and got off with it

Did you plead guilty by post? If so, they will probably adjourn it. They will let you know that they couldn't deal with it in your absence and give you a date for a new hearing that you will be required to attend.

Unless one of them is more than 3 years old?

You can ring Court tomorrow to find out. Ask for the Clerk to the Justices. He/she will tell you.

All the best.

Funny. F funny  :y

Clerk to the Justices will be able to tell you what happened to you in court today. Like...
Dealt with - what points and fine.
Adjourned - when till and probably why.
Not dealt with if they ran out of time - next hearing date.

Yes a ban wipes totting up points out.

But it still costs more on insurance for a ban AFAIK.

You only keep convictions for drink driving and serious offences after a ban. I got 3 points 3 months before being caught again and banned, in effect them points came off when the ban was put on. The only people my previous points matter to is my insurance company, and I think they cancel them when the ban comes up as my insurance goes up untill I mention the ban, then it comes down!
If I were to apply for a new licence tomorrow all I'd have on it is a 28 day disqualification.
