Title: help with health and safety assignment

need help with a health and safety assignment for university. does anybody understand the legal side of this subject. any help would be greatly appreciated. many thanx, kris

Small story, many years ago an academic in a university wanted to demonstrate a new fire fighting system in his lab, the technician refused to do it saying it could injure the students.
The academic fired the system himself and a student was left brain damaged.
The technician was prosecuted under health and safety laws, but found innocent.  :)
The student got a massive payout for damages.
The academic was not charged with anything and was not fired.  >:(

I think it is all about covering your backside.

This is obviously a very short version of what really happened.

I understand it Kris in a commercial sense, as a senior retail manager having to comply with all the regulations, train and monitor staff to action and conform to them, along with carrying out risk assessments to satisfy major company insurance cover stipulations.

Therefore I am fully aware of the legal aspects of H&S from that perspective, but not as a qualified lawyer in that field. ;)

You could check HSE website, depends on what H&S aspects you are looking to cover, but mainly the employer/client is responsible. HSE site you can also look at recent cases where employers/contractors have been taken to court and the outcomes. :y

can be very specific
 task 1 : you need to produce a document that explains the main provisions for the management of health and safety at work regulations 1999 and the CDM regs 2007

task 2 : the report that you produce will aslo need to identify the penalties for non compliance of the HASAWA 1974  and the specific responsibilities  for providing welfare arangements onsite.

 i am taking the hnc level 4 construction course. any help is greatly welcome. pleeeeeeaaaseeee

Top level.

You have a legal responsibility for H&S on a construction project for 4 top level reasons.

1. You have a "duty of care" in common law for the people working for you and others on your site.
2. Your responsibility under the Health and Safety at Work Act 1974 is to provide a safe place of work, safe systems of work and the tools, training and equipment to be able to work in a safe manner.
3. The The Management of Health and Safety at Work Regulations 1999 provide a general framework that ensures the employer actively identifies and manages the risks, by risk assessment, health monitoring, ensuring of competence to do the job...
3. The CDM regs 2007 provide a framework for meeting these responsibilities on construction sites.

I don't know your lecturer, or go to their lectures. But from your information, I would
1. Design a top level document that describes how you risk assess activities, who is responsible for it and how they are documented. How you ensure young people are not exposed to risk. How you monitor the health of your employees. How you maintain training records even. Etc etc
2. Describe how the CDM regs 2007 provides a framework for these responsibilities and activities in a construction environment. In particular, who is responsible for what in the previous step
3. Have a look at this page (http://www.hse.gov.uk/enforce/enforcementguide/court/sentencing/penalties.htm) for penalties.

I did health and safety at college a couple of years ago.  The thing that amazed me is that u can be sacked for refusing to say, lift an item above a safe limit without safety equipment (as an employee) and found a certain percentage culperable in your dismissal - all perfectly legally.

If u are threatened with dismissal and then carry out the task and injured.., once again u can be found partly culperable. In spite of objecting to doing the task, stating reasons.

Doesn't make sense to me but apparently its true.
