Title: storage space needed urgently in wolves
Post by: JueV6 on 30 November 2008, 23:02:07
I need some tempory storage space for Helen's Super Mig.

We had a confrontation with one of the neighbours today and the repercusions could lead to the "supermig" being damaged.

RR, that'll look better with battle scars..lol

Wanted RR REAR NUDGEBAR

Front is already fitted

RR VS Astra sport = No contest

In all seriousness I am wanting to put the Miggy somewhere safe for a week or two until things cool off.

The neighbour WAS arrested for ABH.
I kept my cool and didn't even attempt to have a go back. Much to Helen's surprise.

Thanks LD
yeah i'm fine. a thick lip and a cut to my nose.

I was seriously thinking of putting him on his back by going for the windpipe  "Yes i have had the correct training" ;)
But thought about it before acting.

Although it is not in my nature to take a few headbuts and do nothing. strangely i listened to that little voice inside.  :y :y

Jue,

Due to not having any space down here mate I'm really sorry that I can't accomodate it for you.

Very well done, for not fighting back and hurting someone. I'm sure if it goes to court, your restraint will be looked upon favourably.  If this person has been violent against you without justification, then make sure you take it as high as you can. No time for that :y

Just to add - he that damages a car, IME is too much of a coward to confront a person...

It's not the fact that I didn't want to. It was more the fact that if I had retaliated then the law would have had the ground to make it a provoked situation. as things stand at present, he was arrested under section 47 assault, but as the police were leaving here after taking a statement said it may be changed to section 20.

I hate my mugshot being taken, but they took pics of the injuries, minor as they were. From what was said, because I reported it as an an assault and they had witnessed the injuries, they had no option to arrest the guy even if i didn't want to take it further.

So now we just have wait to see if anything happens ie repercussions, etc.

He wasn't fit to be interviewed until 11pm last night and he was arrested at approx 8pm so we don't know if he was taken to court this morning or was let out on bail. Only time will tell.

You did well to keep your hands in your pockets mate. I would've looked after the super miggy for you, bit crowded car wise here at the mo although i'd have taken her to work, stashed her in a 20ft shipping container & covered it with others, safe as!!!! I'm sure Bertie will look after her, i've met him & he's a good lad.
As for your meathead neighbour, you've used your self restraint, now use your memory. One day the opportunity for retribution will arise.

Every dog has his day! >:(

had a note from WMP. he's been bailed to the 8th Dec, with the condition not to have ANY contact with us. I think thats a bit crazy seeing he is our direct nieghbour, but there ya go. The case has. and i quote: " been passed to the CPS due to the severity of the incident, and they will have to decide on how he is to be delt with". To my way of thinking he seems to have a previous "conviction" for the same type of offence.

maybe i'm wrong and thats how the Police deal with such matters now.

If any of the Boys In Blue ( I know some of you) have any idea'a or comments regarding what happens next, It's all new to me. My last encounter was a self inflicted breach of the peace and was dealt with the following day. CPS is a few steps above my head.

The CPS will consider the quality of the evidence, the justification of the charge(s) applied by the police, its "chances" of being successful in a court of law given the evidence, witness statements, and record of the individual concerned, along with the affects/injuries/damage on/to the IP (injured party).  They will then consider if it is "in the public interest" to go to court. ;)

And good on you Jue!  Well done for not letting the thug obtain a reaction from you and letting the police instead take the action! :y :y :y

You say the guy wasn't fit to be interviewed until later.  Am I correct in thinking he was under the influence apart from everything else? ::) :-?

Thanks for all the offers guys. That may be taken up as things progress, depending on any repercussions, if they happen.

Yes Lizzie. Alcohol. But  to try and force into someones house, is no excuse. Little Chris was asleep on the sofa (2yrs 9mths) Helen answered the door. I only went to it after all the comotion started. It was her that was trying to stop him from forced entry.

If i had retaliated then as i said earlier, the assault could then have been seen as tit-for-tat. but as i didn't they have no choice but to charge him.

And there was an independant witness Lizzie so it's not my word against his.

That is a great advantage, and should assist greatly in the CPS decision making process. :y :y

Seems to me there is a number of very serious charges that can be made against him by the police, but it does all depend on the mood the CPS are in as to what happens next!! ::) ::) ::)

If you had gone for his windpipe you would probably have exceeded reasonable force. I don't know what training you have had but if was formal it may well have elevated tit-for-tat ABH to a charge of GBH.

You did the right thing Jue, and Helen is rightly proud.  :y

If he had got in any reasonable force is allowed if you fear for your families well being, I think a wind pipe would then have been fair game

If he was coming at me and was a threat to my family, in my own home, I would have used any means at my disposal to get him off and out.

If his windpipe was all that was in reach, I'd have used it.

But, as said, it will certainly go in Jue's favour that he kept such a cool head :y

If you can find out the EXACT terms of the bail order, it would be useful. Should your neighbour breach ANY of the terms, even in the slightest manner, you call the Police and he is arrested for the breach, and is back in court within 24 hours. There is no leeway on this .. it is the law.

see section 3.6, specifiaclly .. 3.6.5 :

Combat survival. Points to go for. Groin = Emense pain =  can't fight back when your doubled up, Throat = can't breath = can't fight back if you can't breath.

The ideal situation is a punch/knee/kick to the groin and as the victim starts to double up, a punch or flat hand to the throat. 1st is agony but it's wose when you can't breath or even scream.

I'm getting a bit old & out of breath for trading punches mate.
