Title: ALWAYS HPI A NEW PURCHASE

****A WARNING TO ALL*****

I was talking to my ex girlfriends daughter the other day & she told me she'd had an accident in her car on some black ice.
Then she informed me that the car she'd had was still owed money on by the previous owner to the finance company & Zoe didn't find this out until she informed her insurance company of her accident. Zoe was actually in a relationship with the sellers brother when she purchased the car.

The moral of the story is "NEVER TRUST ANYONE WHEN BUYING A CAR & it would seem, NOT EVEN FAMILY"

So now Zoe has lost not only her car, but also her insurance pay out which will go to the finance company to pay off the dept. The poor lass is £1850.00 down, car less & losses her no claims bonus.

She has learned a very hard lesson the hard way. I lent Zoe the money last year to buy the car & I'm in two minds to say forget the payments you owe me.

So you all out there in WWW land don't fall for the same trick.

Some people are just heartless... good job there are some like you around.  Can you not find any recourse against the previous owner?

A few years back I had a Peugot 205Gti which I bought off a trader as Hpi clear, which it was. When I came to sell the car the man who bought it said that it was the 8th 205 Gti that he was wanting to buy but the first one to come up as Hpi clear!

Always thought the seller wasn't legally allowed too sell if fiance was still owing..if so id speak too a solicitor,amazing what a letter from them can do.

Personaly id let her pay you back...although very considerate thinking about wrighting the debt off. :y

As he's sold it illegally .. it didn't belong to him it belonged to the finance company .. there are a couple of options ...

1. Police ... for fraud /obtaining money by deception ... would the threat of action make him pay the money back ??

2. Civil court - Sue through the county court/small claims court, its a cheap procedure and they can, if they decide .. serve an "attachment of earnings" so even if he has no savings/assets they take so-much a week direct from his pay. Again .. the threat of this and having a CCJ against him might make him pay ??

when I bought my mig, I did a check on it, and it came up clear, I had an old HPI with the car which said it was under finance, must admit, I was, and still am a bit concerned about this, but I did research it a bit, and if you buy from a private seller you have got a bit of protection under the hire purchase act, IF you bought it privately, rules are a bit different if it's trade, and I might be mistaken but I think the trader becomes liable

I agree, small claims court is fairly cheap, but i thought its ceiling limit was about £500......tho may have gone up a bit last time i looked  :-/

Its upto £5000 now....but now i see its a sliding fee....as apposed to a fixed fee.

If you get the judgement in your favour .. your court fees and all other expenses, paperwork, postage, phonebills , etc  ... are charged to the defendant ...  :)  so his bill just gets bigger and bigger .. :)
