Just had a call off a mate, sadly I dont know the answer.
Quiet road, all concel houses, with an off road parking area with some garages appartenyly the area is for use for the councel tennants only and not the ones that have boght thier houses.
His car is sorned and but needs to be moved off his drive to enable scaffolding to be errected for councel house repairs.
Is he legal to park it in the private parking area whilst repairs are done to the houses.

I would say yes as it's not on the public highway but might be worth a call to DVLA to be sure ;)

Surely if it is a private parking area, ie only the home owners/tenants can park there and not part of the highway then I can't see a problem.

For the cost of a call it worth it as the last thing your mate wants is to find a clamp on his car or worse it's been lifted, plus because it on SORN you have to tell them it's being moved ;)

With my housing association our private car parking area comes with the rule that no untaxed or unroadworthy cars may be parked there.
I have witnessed DVLA agency vehicles and staff removing such vehicles from our car park! :o :o :'(

Phone the council and put a note on screen where tax disc should be, otherwise they could have it towed away :y

Nu Labia saw to that.
If the general public have unrestricted access, then the rules of the road apply (ie, it must be taxed, insured, MOT'd, etc) regardless of whether it is classed as private or not.
I live in a private road, it is marked as private at the entrance, etc.....any vehicle I put out there still has to be road legal.

The parking areas are maintainable at public expense, so I would be careful and make that call.
Problem is -- hopefully a mere technicality --- how do you get it to the space without crossing the highway anyway !!!! Picky I know -- but you might get some jobsworth!
Final thought -- if the council are needing the area of your drive clear to put up scaffolding, they should at least try to assist.

as it is council land i would say that the answer is no he cant legally park it there due to council rules
my mate had to move his from the council car park at ther back of his council house
if it was a private car park like at the back of mine there would be no problem parking there

Just found out this parking area hasa gate to lock the area off. Dont know if this would make a difference.

DVLA changed the rules for SORN'd vehicles a while back and afaik this is the general gist.....A sorn'd vehicle now has to be either on your own driveway/land or at a place of repair, ie a garage.
You cannot now, for example, park a sorn'd vehicle in a private pub carpark if you dont own the pub that is.
So as i see it, parking it in a private carpark, that you dont own, is a no no too.
