In September Mrs. Looknee had over £400 taken out of her bank >:( so cancelled her card etc
At the end of September had a knock at the door, so answered it and a delivery man was there needing a signiture for the parcel he was holding which was addressed to Mrs. Looknee, so I signed for it thinking she had bought something for Christmas.
She opened the parcel to find two Brand New Nokia N97 phones :-? which neither of us had ordered. The following day a letter from Vodafone came telling us what contract "We" had, which was £98 per month for both phones :o
So I got on the phone to Vodafone to explain there has been some mistake.
Around 20 phone calls later (each for about half an hour long) and not a single reply.
So on the 2nd of October I wrote a letter to the Managing Director of Vodafone with all the dates that I have phoned, explaining that I have not recieved a reply at all etc.... about the two phones that we have here...
And still no-one has contacted us to pick them up :-?
I have been telling Mrs. Looknee to sell the bloody things as I can get £500 cash for the pair of phones, but she won't....
Would we get into trouble if I did sell them?
How long is it until they become ours?
Should they be compensating us for all the phone calls made, time wasted etc??

If you renew a contract you have to accept TC's which they HAVE to read out to you on the phone, or sign in person.
If there was no paperwork inside the boxes linking you to the phones, sell them :y

We also went into the local Vodafone shop in Hanley Stoke-on-Trent explaining all this (the girl even phoned the mobile number that whoever opened the account had given, there was no such number)... and showing the letter I had sent to the MD. She then sent a copy by Fax to someone high up within Vodafone apparently she knew. But still heard nothing :o
In answer to your question, no money has been taken by Vodafone as they have the wrong details.

The only thing link us to the phones is they have the Correct Name and address, birthday etc for Mrs. Looknee (god knows how though) but totally the wrong bank details

If they are not taking any monies then i wouldn't be too worried about it, however for my own piece of mind i think i would run a quick equifax or possibly experian(being as its vodaphone) check to make sure that some F**cker wasn't responsible for me getting a default for a phone i didn't order or even want. :y

Tunnie, we have always had Virgin phones mate, so never ordered a Vodafone phone, so not a phone number I know at all mate, there is sim cards and everything inside with them

If they had money out of her account then the rest of the details really arn't that difficult to find out, electoral searches etc etc. :(

You have done all you can to resolve it. If they are not chasing you for anything I would write to Vodafone recorded delivery informing them that you have been storing this incorrectly delivered package for them, you have explained that it was not ordered and that you will dispose of it if not collected within 7 days.
Wait 7 days, check it arrived and then do what you want with them.
Incidentally, I got one of my credit cards stopped recently due to a fraudulent transaction - Vodafone! Seems like they are not asking enough questions. >:(

Sorry Daz a credit check if they have had money from the account and registered a phone in her name (credit search needs to be done) you may want to see what else they may have done >:(
Happened to me a few years back i know subscribe so i can access mine anytime. www.creditexpert.com is the address i think. Free for the first thirty days but then you must cancel or its a rolling 7 quid a month. HTH :y

No we are Virgin customers and have been for years Kev.
It seems asthough someone has ordered them but why I don't know as they have not got the phones to sell :-?

Vodafone have not contacted me at all, even though I have phone honestly around 20 times, been into the Vodafone shop (who faxed a copy of the letter I sent to the MD to someone) and sent a Recorded Delivery Letter to the MD of Vodafone.
You have done all you can to resolve it. If they are not chasing you for anything I would write to Vodafone recorded delivery informing them that you have been storing this incorrectly delivered package for them, you have explained that it was not ordered and that you will dispose of it if not collected within 7 days.
Wait 7 days, check it arrived and then do what you want with them.

What Kevin suggests is a cracking idea, since no money is being taken and its their fault. You have not agreed to any contract, and you have never been in touch with them, you are on firm ground. They now have to prove you took out the contract with a recording of your voice accepting TC's or relvant signed paperwork.
Get proof of postage (with tracking number) signed for works well, i used it for expenses. Its trackable and signed... then if Voda come knocking, ask them to find that letter which you explained everything.
Write to them as Kev says, and will 'dispose' of them shortly.
Then eBay them :y

For mobile phones, where direct debit is involved, 90% sure you have to sign something and return it. Even when applying online

Keep records of your communications with them, and if you're 100% positive they will have nothing that could be construed to be acceptance of a contract you should have nothing to worry about.
Might be worth a trip to CAB to see if they can suggest anything else you might like to do to make sure you're in the clear.
I would suggest a recorded delivery letter saying you're fed up with trying to contact them, you have not ordered this service nor the 2 phones and, unless you hear from them, you consider the matter closed and you will store their package for a further 7 days before disposing of it. But I'm not a lawyer!
They'll probably end up sweeping up all the garbage in their system in a year or two's time and "selling" the supposed "debts" to a collection agency who will then start hassling you. >:(
.. and checking what the credit agencies have on you when the dust has settled is a good idea.

I think its fair to say that you may well have "WON" the phones the only thing connecting you to them is if you signed the delivary note from said courier :(
But as someone is obviously privvy to some of Mrs Loo Knees personal details i would definately check her credit report. These things can be very damaging, took me long enough to sort >:(

Vodafone have a 7 day cooling off period, as long as you made contact with them within 7 days, saying something like, not mine, dont want it, ordered in error, what ever, I would have thought you should be Ok.
They are pretty good at making notes against calls, so it should be on record.

As obviously Mrs Loo knee's details are being used, I reckon you should inform the police and trading standards, plus checking all her bank accounts / credit card accounts for unusual 'movements' of transactions. It seems to me a case of ID theft, with the goods reaching you when the 'buyer' did not intend that to take place.
Needless to say you and Mrs LK must be on your guard for other events!! ::) ::)

PS I would never sell the goods, or dispose of them in any way, until all this is legally resolved, as doing so could complicate the issue with Mrs LK still being held responsible for their value! ;)

I have just got off the telephone with these people.
They have told me to write another letter to Vodafone stating exactly whats underneath
These phones are Unsolisted goods and for the purpose of Consumer Protection (distance selling) regulations 2000.
Unless Vodafone collect the phones within 28 days I will treat them as a gift.
But what I have just thought of is if they do collect them they wont be giving me anything for my wasted time and phone calls!! >:(

daz if i was in your crocks mate i would write to them and it registered delivery that means you can check if they have received your letter tel them you are charging them storage fees of say £30 amonth each they will soon get back to you mate.also if you signed for them they say that it is like signing a contract and therefore you are responceable for them.i have been with vodafone for twenty years mate .this is the customer services number to ring .08700725625 give it a buz good luck mate! :D :y pete

Pete I have phoned that very number to many times to remember mate being honest.
Not one singal person got back to me.

Most of the tips have been summed up. Keep everything in writing now and recorded delivery. You should also prepare a claim against Vodafone and give them 28 days to pay up.
If Vodafone want the phones back then they must be collected at their own cost, so don't sell them just yet. :y

If I was you youth, I would write to Vodaphone telling them whats happened detailing all the calls, visit to the store and what its cost you in time and effort. Then I would give them a date (2 weeks time) in which you would expect a reply and stating that if you haven't received a reply by that date telling you when they are collecting the phones and reimbursing you for time and effort the phones will be sold to cover your costs. Send it recorded and keep a copy :y

That is in a nutshell youth what I am going to do :yn but I have just phoned this Ofcom place back and aqsked if Vodafone domcome and pick up the phones within the 28 day period will they be compensating me for wasted time and phone calls etc?? he says it is hard enough to recover any money if you have all the reciepts let alone if you have not.
The only thing I could do is have a lok through our phone bill and give some sort of estimate!!!

By the sound of it the phones have been obtained by deception using your details - so despite vodafone's appalling customer service they are unlikely to just let you keep them otherwise they are setting a precedent and they are unlikely to do that. If you do keep them then vodafone will just block the units so they are useless, they can't even resell them even if you do return them as the seals on the boxes have no doubt been broken and the phones are now second hand so they will be scrapped anyway.
No doubt they will try and sell you an 18 month contract to keep the phones at some discounted rate....
