14 days to the registered keeper of the vehicle. Deemed served if proof posted within the 14 day period. No written NIP if driver stopped and verbally warned at the time of the offence.

Hi,Firstly I would like to thank those members who positive replies made my son in law check the dates on the NIP.
Gwent police had taken 19 days to issue the NIP between the date of offence, and the posting date of the NIP.
So I have to ask, what steps should he do next, ignore the letter, phone them, or take legal advice.
He was confident that he had slowed down soon enough, not to get a ticket,he reckons the camera was at least 500 yards away.
Anyway thanks again in advance for the advice.
Alfie.

If your son/whoever is the registered keeper of the vehicle in question, I would suggest that you ask for verifiable proof that the NIP was posted within the 14 days whilst at the same time, obliquely advising them of your understanding of the 14 day rule prior to taking legal advice as to your next steps prior to Court process.
If they produce what you request then verify the posting details etc before taking legal advice.
If they drop the case at this point, you have won a watch...
Ensure that at no time is liability assumed nor indeed, suggested.
Its their mistake in the process, not yours..... ;)

This is a fairly major point as B suggests, as if your son is not the registered keeper there will a time delay, between the registered keeper sending the NIP back and it being re-issued to the 'correct person', which could be more than 14days. I used to get quite a few NIPS sent to me when i used to rent cars out...so if goes more than 14days but 14days or less for the registered keeper to get it.....nothing you can do, i dont think.

Hi,you have a a valid point there,it is a company car,but he is the keeper.

Ahhh.... but not the registered owner, were the NIP will have been sent first.....then sent back, then re-issued to your son......so more than likely with a day or two in the post each time....it would have been issued within 14 days.

Its not simply a valid point, its a CRUCIAL point....
If the registered keeper - The Company, PLC - receives it within the 14 day period and promptly returns the NIP naming your son as the person responsible for the day to day operation of the vehicle, then the NIP is deemed served.
Thereafter its upto your son to pass the buck onto whomsoever was the driver or to take the strap himself, if so responsible.
As said in the initial response to your quest for info.... :y
