my sisters boyfriend has points already for doing over hundred on the motorway he was lucky he got a copper who said he was only doing 90mph so he could save his licence.since that he is due in court for doing 60mph in a 30mph zone..now ive told my sister hes gonna get banned and she thinks if he can say he needs his car for work and child care for their son he will just keep it full to the top with points..now i think ban, anybody else concur :)
oh if anyone replies and i dont ive gone to bed :y
-
mmmm maybe ban.
-
i always thought if yer was doin double the speed limit it was a ban..could be wrong though
-
Don't take this the wrong way but, 60 in a 30 limit is a bit rich in my book, was it a residential street, or near shops or schools.
From what you have written I think he needs to be banned.
-
30 over whatever the limit is is usually a ban.
Firstly, after getting off lightly he didn't take the hint and slow down. If I was 3 points from a DQ and I needed the car for my job/family, guess what? I'd rather slow down for a few years!
Secondly, wtf possessed him to do 60 in a 30? Ok doing a ton on the motorway I can see if the conditions are right. If you get caught then you take the consequence. Doing twice the limit in a 30 is asking to kill someone.
Sorry, no sympathy. If it was up to me he would hang >:( >:( >:( >:(
-
60 in a 30? What a prat.
-
Im willing to have a friendly wager that he'll see AT LEAST a 6 month ban.
How old is he, did he have his kid in the car.
Its nice when you get a copper who will look at giving you a break, but if you dont heed the warnings then you deserve everything you get, trust me, i know only too well (3 months in chokey, 3 year ban and extended test, then the insurance premiums taught me a very hard and valuable lesson)
-
i dont know where it was i dont see her that often so dont know the full facts apart from the amounts and i too think ban..if your in a 30 zone and doin 60 your bein dangerous
-
You can be banned for breaking ANY speed limit by ANY amount. It depends on the circumstances. For instance 40 in a 30 limit near a school at going home time will almost certainly incur a ban, whereas the same speed in a road not near a school and at say 8:00 pm would probably ony incur points. If a ban it could be of any length. You do not say how many points he already has on his licence, but if this offence brings him up to a total of 12 or more he will be banned under the totting up procedure for up to 6 months unless he can prove exceptional hardship (which is a reason that can only ever be used once). From what you have said I do not think that he could say he would be caused this, so I am pretty sure he will be looking at a ban. As others have said already he should have taken the hint and slowed down and not put others in danger by the manner of his driving.
-
speed limit plus 50%=ban, :y but i know people do 80 in an 30 and only get 3 points
-
Well if he gets banned, then has to rely on public transport or taxi's to get about, maybe he'll start thinking about what he's done, as it's going to be expensive on public transport, taxi's, and as well as the fine itself, and all for what was a lack of sense.
And if he was driving like an idiot with his son in the car with him, perhaps he needs to have a rethink about his driving for his sake, and not to use him just as an excuse just to keep his licence ?.
30mph tends to be in residential areas, so if he was doing 60mph through a residential area you have to wonder if he is even concidering others on the road ?.

How do they get away with that then ?
-
i suppose i should of had full facts before posting this but im going on what i know and just getting a rough feedback off you guys on your thoughts..i dont know what points he already has but going by they are speeding points i wouldnt think that matters and i dont know if he had his kid with him or what sort of area he was in but your all backing up my thoughts and he will i think get a deserved ban(the guys a dick anyway)
-
He could also have his car seized and made to take an extended test before he could go back on the road when he is undoubtably banned.

Here goes, I know of a number of 30 limits 60 or 80 even is safe in.
One is 1/4 mile outside of a village on a hill away from it.
Virtually everyone does over the limit down as you are out of the village heading towards the 60 and using the hill with fields either side to accelerate.

See no houses - 60 here is fine.

He's probably called Ashley Cole and can afford a high price lawyer who can find the smallest technicality

Cheryl said he's only got a small technicality.

60 in a lot of 30s though is not on. I have seen the results of doing 50 throught the village I work in - we got to see the air ambulance, a wrecked Nissan repmobile, a rep in a stretcher and a damaged beer lorry.

Don't think so - it was moving from one pub to the other.

Not at all, spoke about it on here before. I was 19, had a 2.0 Sierra which I had a nasty prang in. Nothing was illegal except my speed, car was tip top, no drink inside me, but I was showing off to my mates like a knob when I lost control on a corner and slammed head on into a quite new mk2 Astra.
10 people in hospital (5 in each car), no life threatening injuries thank god, but they quite rightly threw the book at me for dangerous driving, hence the 3 month sentance, 3 year ban and extended test.
Still see it clear as day and although no one died, you never forget the screams from BOTH cars occupents.
Certainly taught me a very valueable lesson!

http://www.sentencing-guidelines.gov.uk/docs/magistrates_court_sentencing_guidelines_update.pdf
Page 131 is the definitive document
Note that those guidlines are for a first time offender, pleading guilty in the Magistrates court ... any other circumstances (repeat offender, not guilty plea, transfer to Crown court) will affect the outcome.. ....so page 145 para 2 will be involved as well ... also page 171
HTH :)

Before I give my opinion I'll qualify it slightly... I have spent a couple of years of my life clearing up the results of accidents and seen some truly awful sights, as have the serving/retired police on here. That hasn't made me an angel and I would never pretend that I stick to every speed limit I see. But, 30 means 30, 40 means 40 and (generally) 50 means 50! I must confess that the white disk with a black stripe is, in my (wrong) opinion, fair game. I was lucky to get let off with a slapped wrist many years back when I was stopped doing over 100mph... It was the middle of the night and the motorway was virtually deserted. I got stopped 8 months later doing 43 in a 30 (dual carriageway and the limit had changed from 40 to 30 a few weeks earlier) which I accepted as my fault immediately... I learnt a lesson and slowed down!
The character you have described deserves to be banned for the maximum time possible... He got let off once before!

After getting pulled at stupid o clock in morning /night an the heads of the valley road from Rhymney to Dawlais by a unmarked from Blackwood, he started flashing me at 70 so I sped off reaching in exes of 120 in a fast as foook sierra, I stopped at the petrol station pulling in at a ridiculous speed still he then at that point showed me his badge, I riped in to him about his approach I proceeded to tell him I was glad he was a officer and not just on one. Well he booked me for doing 80 surprisingly it never made it to Court neither did I pay the fixed fine, unfortunately for me he then pulled me a week or so later after picking up a new car and booked me for the no tax and insurance, that made it to cort resulting in a ban.
So in conclusion 60 in a 30 under no threat or without a plausible reason for doing so (such as fire fighter on call) Ban in my opinion

Oi leave my local copper alone :D
I'll have you know, that wasn't in that article, that the very next day of this coming to light he was out near my house with a radar gun in a 30 zone...the tosser :)

After driving as you did, I'd have personally been very sheepish and apologetic ;D
