Title: People parking on the grass/public footpath.
Post by: Del Boy on 16 April 2010, 17:44:46
Outside my house there is a small green, with a pavements either side, a woman opposite bar a couple of doors is constantly parking across the grass and footpath. She has to travel across some grass to get to outside here house, then turn left across a path and yet more grass to reach outside her house. Now not only is she churning yp the grass and making it look an eye sore, she is driving across a public footpath. I've rang the council 4 times they keep saying they'll send someone round and never do, rang the police they said "oh it's a council matter ring them." Now what could I do to stop this happening, shes not the usual type we get moving here, everyone knows everyone and everyone looks out for each other she doesn't say anything to anyone. Now my road 99% of the time there is a place to park, there is also parking for residents out the back of their houses as there is for her and there is always a space for her but, she keeps parking on the grass.

Last time the mrs rang the council about a month ago now they said to her "Right ok, i'll put it across to the guy who covers your area and he'll do something about it." Nothing yet and this was a good month if not longer ago. Any ideas what we could do? Others are complaining too not just us.

Normally I would say try your MP --- they are next to useless but council's do generally jump when they get an MPs letter. However, since the dissolution of Parliament (at last!) you haven't got one!  Try after the election maybe.

Good thinking, maybe take it to the papers as bad publicity for the council?

Write a polite note asking her not to park there....

then nail it to her drivers' side door  [smiley=evil.gif] [smiley=evil.gif]

Wrote notes, spoke to her, mrs went loopy at her she still parks there (which is strange because when the mrs goes mad I run.)

Take some photos., send them to the local newspaper, with a letter saying the council and police are doing nothing about it.

Any ideas what we could do?
Probably a bit of a radical idea (especially in this day & age), but what's wrong with knocking on her door and telling her personally what the issue is?

If it has got to that stage, I sure as shit wouldn't be expecting the law to help me.

If and when you talk to the police Del bear in mind the law:

"

You MUST NOT drive on or over a pavement, footpath or bridleway except to gain lawful access to property, or in the case of an emergency.

[Laws HA 1835 sect 72 & RTA 1988 sect 34]"

In addition:

"
You MUST NOT park partially or wholly on the pavement in London, and should not do so elsewhere unless signs permit it. Parking on the pavement can obstruct and seriously inconvenience pedestrians, people in wheelchairs or with visual impairments and people with prams or pushchairs.

[Law GL(GP)A sect 15]"

I recommend you quote those laws, and make it clearly understood you are lodging a complaint based on them. ;) ;)

It's not a drop curb or anything, there is parking for residents behind everyone's house as there isn't driveways at the front as it's a public footpath and grass.

Oh and thanks LZ will get onto him  :y :y

Unfortunately Liz, the filth don't give a toss about anything these days unless there is money to be made.

That's what you may believe KW, but believe me the police in Kent do care - a lot- and it is highly insulting to them to suggest they only do it to make money.  Very far from the truth for us in the know!!

Need to print this out to give to pedestians when they just step of the kerb with out looking and get blasted with the hooter,, there responce is normally a load of swear words.  my reply to that is "You dont walkinto the path of a moving car and I wont start driving on the pavements"  ::)
