Title: for god's sake don't scratch your ear..........

whilst at work driving my little blue van i was chatting to another engineer on my full handsfree car kit with phone in cradle, when i got pulled over by a traffic cop.
he asked me do you know why i have pulled you over to which i replied "not a clue". he stated i saw you talking on your mobile phone which was to your ear.
i was totally confused and stated the mobile hadn't left the cradle in the last 20mins and the handsfree system is operating ok.
 he said he was 100% sure and asked for my licence to which i said it wasn't on me. he also asked did i have any points and i said no.
i told him that we all make mistakes to which he took as an insult and threatened to charge me anyway.
the upshot was that i insisted i was not on the mobile(to my ear) and he would have to do what he had to do- and then he just walked away, nothing said just wandered off !!!
now i am one of the good guys towards the police but pratts like that spoil it for the rest of the decent bobbies........ ps if he did charge me what is the upshot of his word against mine and how could i prove he was mistaken ????? >:( >:(

I am afraid we all have to get used to living in a police state. I lost faith in them about 2 years ago, and I still have a clean licence.
They are there just to make money from the little people and protect those in thier ivory towers.

Unfortunately your phone records won't show whether you were using your handsfree or not. Only what time you were on the phone from - to.

On the millionth repeat of Road Wars the other night, the police were shouting madly and sounding their horn at a guy with his mobile to his ear. He just ignored them until they forced the car to stop. They asked him what the hell he thought he was doing and he carried on with the call. However, he did pause long enough to tell them he was not driving as the car was left hand drive so he had committed no offence. No apology from the officers for their mistake but they did look a bit red faced.  ;D ;D

If it went to court the phone provider would have the relevant info, it's on your bill.

If it went to court the phone provider would have the relevant info, it's on your bill.

That he's on the phone isn't in dispute. The provider can't tell if it's a hands-free call, though. ;)

Try living in any of the South Europe countries where the police have the power to fine you on the spot. They don't even know their own laws either. If you don't insist on a receipt then mostly it is believed that they pocket the fines. I'd say that Britain isn't a bad place for the innocent. :y

First off I was pleased to hear the plod bothering to enforce that particular law at all. I dont think people are aware of it. Personally I don't mind as long as driving is nor affected, which it almost always is.

"hmmm that car is behaving oddly, bet he/she is on the phone.....   ....yep, phone to ear yacking away"

Shame the plod was a tw@ though. Trying to hide a red face by the sound of it.  ;D
