some over stressed women in a Mum bus reversed into me in Muckdonalds car park. Chrysler grand voyager full of kids.
She gave me a mob number and appologised. On phoning she had turned into phsycho bunny boiler from hell, screeming kids ib the back ground, she said "there is no damage, i think you should forget it ever happened, and why are you ckaiming off me when its your fault" and hung up.
Anyway, rang Direct line, reported it and gave details of 2 witnesses plus her number. Week later i get a letter, while thinking "i bet they're saying 50/50" and guess what,
Dear sir, both drivers have a duty of care in these situstions, this case will be delt with on a 50/50 basis.
So having had this happen on 3 occassions before and twice to a mate, i've become wise to it. Yes we get driven into alot round here.
As has been the case in these 5 instances, and several others i know of, it seems to relate to the Royal Bank of Scotland group of insurance companys, drect line my insurer is one of these companys as is Tesco insurance who cover bunny boiler in the mum bus.

This is a conflict of inerest as far as i'm concerned.
The odds of another RBS insured driving into you is vastly increased, and this situation keeps arising. Its in rbs intersest to sign off these cases as 50/50 as they dont have to pay out, in most cases prople fix thier own relevent damage or simply wear it. Yet if 50/50 is accepted both partys have an incident recoreded anyway raising thier premium.
You do nit have to accept 50/50 just because they cant be arsed to sort it out.
And you do not have to have your vehichle repaired by thier approved repairer either, muppets mostly, using pattern parts
Scam imo? or am i missing something.
Should add, having been very specific in my description, it seems thier has been some sort of admin error. Thier system reports "2 vehichles reversed ino each other" simply not what i said. Funny how that happened isnt it? have they spoken with the witnesses? no. Have they spoken to the bunny boiler? no. Have they spoken to her insureance company? no. Just edit my statement and do what you like...

Get a lawyer on it right away. and charge it to them.
This crap happens far too often. Dont let them get away with it!!

Makes you wonder why we pay insurance in the first place, because when you call on them they're not interested :(

Last Oct when SWMBO's Astra was hit it amazed me how quickly the 3rd party insurance company contacted me to try to tell me that they were collecting her Astra for repair & they were dropping a courtesy car off. Needless to say, I took her car to where I wanted for assessing. :y

One reason why I don't take out legal expense cover with policies.
My union for all it's faults will fight a case for you tooth and nail to see you don't lose out, good on insurance claims (well their solicitors are) crap at representing you in the work place.
Glad my ins co not on that list, Morethan. Ditched Direct Line years ago, didn't like their attitude.

I think insurance companies record every call as a matter of course. So you could challange the statement and demand to receive a copy of the tape. I'm with LV, and when I had a broken window, there was no hastle at all, just take it to autoglass and it was fixed.

Maybe we chould start using these roadhawk car camera/recorders, which would hopefully prove who caused the damage.

Direct line are not the best insurer by any definition, but, I have had worse insurance... I can't remember who, but, I had a car slam into the back of me, I contacted the insurance, and they did nothing... I changed the car in the end... :s

They do indeed record calls Ken, and i've demanded it be re played as part of the complaint. They seem exceptionaly well versed in dealing with the acusations i've made. Its as if they have to threaten 50/50 as a start off, and i'm quite sure people roll over and accept what they are told, standard operating procedure it seems.

Back in April i was innocently waiting for my mum to visit the local bank, and moved into a space vacated by another vehicle - i parked my car, a then Vx Carlton, into the space and switched the engine off.
To my amazement the "other vehicle" then reversed back into my parked car, smashing the O/S headlight >:(
Very disconcerting watching another vehicle heading straight for your pride and joy waiting for the impact...[smiley=dankk2.gif]
The driver of other car was very sorry and gave me her address etc, i took the number and cleared up all the glass. Reported incident to my insurers - dusted...or so i thought.
My insurers said she had subsequently claimed against me, saying i had hit her car while she was pulling away...i thought uh oh here we go... "any witness?" of course not, so 50/50 it was, awarded £100, paid for a new h/light, a re-mot (been done a month before) and VIC test i never got round to doing as i scrapped the car, but on renewing insurance for my new Miggy found my 7 years no claims had gone down the swannee.... :'(
In USA some insurers insist on an on-board car cam to record incidents and discrepancies - bloody good idea! 8-)

Based on my experence (white van man hit me). Dont forget the insurance company work for you, it is up to you how they represent the case legally. If they refuse to push for your claim as opposed to 50/50, they have to pay out to you as if you have won 100%, ie. no cliams, excess etc. My next half of the rant comes as the son of a copper, they will hate you for it, but stop straight away and call the fuzz, take some pictures, witnesess etc.
Last thing is, unless it has changed lately, most company car parks are private property and as such you ins. doesnt cover you (tesco etc is private land). Insurers will pay 50/50 on most claims as matter of course but only because of the publicity vs general low cost per claim of car park claims.
Al
