Title: Re Chester Services
Post by: Andy B on 13 November 2010, 19:43:37
Did anyone else get their 'Parking Charge Notice'? ;) Mine arrived this morning. Apparently I was there 3 hrs & 9 mins and they've 'photograhic evidence on file to support this claim' Why didn't the bloke in the patrol van tell me at the time?  ;D  ;D  ;D

I do hope you're not going to pay it? Write back and insist on them taking you to court, save the letter on the PC and just change the date and re-send everytime they write to you ;)

I'm not planning on even acknowledging it, let alone paying them  :y they want £80  or it's reduced to £50 if paid within .... so many days.  :y

I got one of those when i used a Morrisons car park for 3 1/2 hours, those letters try and scare you, expect further one in a couple of weeks with a nice photo. Then a following one from a 'billing department'  saying Bailiffs will be called, and court action bla bla bla.

It would cost them more to take you to court, they can only get the fee back there is no loss of earnings they can claim for so its pointless empty threats.

Probably scared that you all were going to beat him up, or at least an infringement for taking your photo without his permission  ::)

I got my 'reminder' a few weeks after the original 'PCN' and today I've had my third letter from them.
This is now **LEGAL ACTION PENDING** and there's now a further £40 on top of the original £80 so apparently I can can pay my £120 via cheque or postal order  ::) ::) ::)
Do you reckon I should just ignore it again or send them a letter suggesting they're harrasing me ........ (borrowed from Richard H of ABS - thanks  :y)
1997 Prevention of Harassment Act

"The Act defines harassment in section 1(1) as a "course of conduct" amounting to harassment and provides by section 7(3) that a course of conduct must involve conduct on at least two occasions. (Originally these occasions needed to involve the same person, but in 2005 the act was amended by the Serious Organised Crime and Police Act so that "pursuing a course of conduct" could mean approaching two people just once.[1]) If these requirements are satisfied, the claimant may pursue a civil remedy for damages for anxiety: section 3(2). The use of civil law, means that the standards of evidence are substantially lower than for criminal law, for example permitting hearsay.

Under this act the definition of harassment is behavior which causes alarm or distress. The Act provides for a jail sentence of up to six months or a fine. There are also a variety of civil remedies that can be used including awarding of damages, and restraining orders backed by the power of arrest"

Nope, ignore ignore ignore, got a very similar T shirt. Thanks to Kev and others on here for their advice on mine in B+q car park, when I had purchased from the store but took 2 bays at the other end of 75% empty car park. I hate getting my car dinged in their too small spaces.

break em, bin it and and have a lovely Xmas.  ;)

;) I know you`re very savvy and well on-top of the tricks practiced by these parasites, Andy.....but what is terribly upsetting is the fact that their tactics must intimidate large sums of money out of the less confident and aware; my Father (for instance) whom I know for sure would`ve simply paid-up when the first letter arrived and felt ashamed that he`d committed an 'offence'. :'(

Through the years there`s always been, societal "low-life": in the 50/60`s it was blackmailers (preying on gays and unmarried mothers), then the era of doorstep money-lenders and Rachmanesque landlords, then the intimidatory bailiffs and their compounding-charges came along and now it`s parking 'enforcement'......a lot of suffering has been caused by people whom contribute naught; just taking from others. >:(

Lots of good advise been posted Andy. Also can they proove the car they photographed was not on a cloned number plate? :-/ As Debs says a lot of people will pay up to these parasites no questions asked because of their misplaced sence of "fairplay" These companies are just a bunch of low life scum and if I where you I would tell em to WEDGE IT!!! >:(

If/when I get another letter from them, I'll compose a letter back to them including the above reference to harrasment.  ;)
