Title: Bought a car, where does he stand?

My brother back in january bought himself a Lexus from a used car dealer local to us which tends to specialise in nice cars, at the time of purchase the dealer stated it had full service history and he was waiting for the previous owner to drop it in, it has taken over 8 months to finally get a service book...

in the meantime my brother had checked out from lexus as to whether it did have service history, which it does, mostly from main lexus dealers, and so we were  just waiting for the book which even now has never surfaced. we called in last thursday and the dealer then produced a booklet with service details written in, which they had written in themselves from information they claim to have got from Lexus, now although we know for certain it has full service history, the dealer wrote a service log for the 50k service, even tho we know it wasn't done at a lexus dealer

I'm just wondering whether anyone knows where my brother stands by way of getting his money back on the car.. on the grounds that the dealer never managed to provide the authentic documents of history they said it had with it at time of sale

This brings back memories, as you know mrs miggy had a full refund, although the circumstances are different, you can argue, discription of sales act, the item is NOT what the salesman said it was, I know there is service history at Lexus but it is up to the dealer to chase this up from Lexus, he could get copies of the service details from them.

I am not sure wether your brother would get his money back after 8 months but he could certainly ask the dealer to get the records.

Give it a go, also ring trading standards for their advice as we did.

Very difficult to get a positive result on this the reason being,

it has been 8 months you could/should have pushed this much earlier,

The Dealers can garantie that the work had been done there, the only thing the car salesman has done wrong is thr last 50k service, and he could just say that it was a mistake, so apart from an argument, i dont think that much will come around.

he's e-mailed trading standards, we await their response, as for the 8 month delay, he visited the dealer every week on his day off, they have no excuse

Take it to Trading Standards see what they have to say then contact the dealer to make him aware, I'm sure you have rights under sale of goods act, if the worst comes to worst you could threaten to take the whole story to the local newspaper   :y

I would use this as a last resort as you may get their backs up but no harm in slipping it into the conversation  :y

Here are my indpendant thoughts:

If your brother was to sell the car now with this new service book it would not affect the resale value at all.
He's happy with the car and you personally know the car has been maintained by Lexus.
Too late for a refund....and does he really want one anyway?

I'd be looking for a degree of compensation for the weekly trips, calls etc and the 8m wait.  Just got to decide how much he thinks is reasonable then open negotiations :-?

in honesty he just wants them to get the correct and genuine service history the right way instead of have him ****ed about for so long!

i may need confirmation from him but i'm sure the dealer said they would get a new book and send it to each dealer that serviced it and get it filled in and stamped properly, not just ring up and fill the details in themselves from what they were told on their own

update, the service history has been confirmed to be completely inaccurate having allegedly been serviced at 29,000 when it only had 27,000 on it!!

they just guessed and wrote it down!

my brother is happy with the car, as lexus themselves have confirmed it does have a genuine service history on record even if not on paper, and had it's important services done at the correct time, therefore my brother wishes to take no action as he will have no problem selling the car when he needs to. However since ADSHEADS of MANCHESTER ROAD, WESTHOUGHTON completely faked the service history, they have committed an offence, and trading standards are now involved, they have the copy of the fake history book along with the e-mails from lexus confirming the actual history

might nip in to adsheads and tell them the wonderful news... ;D

I think there are two separate issues here. Trading standards definitely need to know that the dealer faked the service book. But with regards to your brother, I don't think he can demonstrate any loss resulting from the current situation, or that he is unable to make full use of the car,  so he is not eligible for any actual compensation... that's my thought on the matter.

hence why he's taking no personal action and not intending on returning the car to them

Many of you will be familiar with this thread when I posted up the trouble my brother had obtaining the service history

did any of you spot this garage on Rogue Traders last night as their Clutch Specialists were robbing people of cash for shoody and unnecessary work??? :y
