sold a car last week ,as sold as seen , they came and took it away ,and now phoned me tonight saying that they want there money back as the fly wheel has disintergrated ,and its pulling to the left ,
i was using this car every day and had no probs ,
where do i stand with them wanting there money back ??? :-?
-
stand firm, it was sold as seen, no agreement was signed. Its their problem.
If they wanted warranties, they should have bought from a dealer.
-
Do you have anything signed by the buyer advising they agree that the car was purchased as "Sold as seen", no warranty etc ?
They could have ragged it to blazes over the last week.
-
got them to sign a receipt stating the reg the model and how much ,, sold as seen
also i made another one to them which i signed sold as seen
they say there coming round tomoz ,, should be fun , going to check on citizen advice tomox after work :y

Buyer beware, its upto them to make sure the car is what they want, once they've handed the cash over its tough.
I sold an Elite Estate at the end of July, got a phone call at the beginning of the week saying it had broken down (think its going to be the crank sensor) so i'm going tomorrow to have a look. If he supplies the part I will fit it free of charge, but then i'm good like that ;)

there saying that i should have noticed all this ,had the traking done ,2 new tyres ,and it started first time ,all the time ,

You have nothing to worry about. Its sold as seen, they should have looked at the tracking. Assuming it was not pulling to the left when it sold, who's to say they have not smashed it into a pavement and done this damage them selves.

No, they should have noticed it.

i shall have to keep u all posted ,they took it for a test drive aswell . and said it runs nice and smooth :y

What say we all meet up at Mick's house tomorrow! There could be quite few OOFers to 'discuss' the other party's problems! ;D ;D ;D

your all welcome :y :y

'Caveat Emptor' mate, 'Let the buyer beware'. even if you hadn't told them it was 'sold as seen', they don't have a leg to stand on as long as you didn't try to hide anything or 'misrepresent' the vehicle in any way, sold it privately and are not a car dealer. Don't be worried about the 'home visit' either, at the first sign of any argy bargy, go inside & shut the door! Better still, don't answer it! :y
-
Yes mate stand firm. They had a test drive and were happy. You pays your money's and you take's your chance on a private sale.
Dont be bullied, they've broke it and are trying it on.
If it starts to get messy or violent then call the cops.

I would just tell em that u was happy to sign a sold as seen notice and everything had been good while u owned the car and it isnt your problem.
-
They trying to rip u off, they should of looked over the car. its there fault, tell them to go away and grow up. :y :y

just a scare tactic i think as she knows she has lost :y

if they call again say you are calling the police. it harsment and you are in the right. let them get the fine.

She is throwing more money away going down that route. As I said earlier, as long as you said or did nothing to misrepresent the car before sale, she hasn't a hope in hell. Mind you, I feel sorry for her if the car just decided to give up the ghost after she bought it, but that's life isn't it? :(
