Yesterday turned out to be a complete nightmare.
After travelling to Scotland to buy a new mig, the OOF owner informs me that he can't find the MOT certificate, but promised me it was def done!
After handing said pennies over & filling up, I headed home. I got as far as Lockerbie when the police pulled me over. It turns out that the MOT had run out on the 14 Nov >:(
I was taken to the station, cautioned and processed. I rang the OOFer who said it was MOT'd, I asked him to get the details and get back to me. He did so, but apologised & said no, it didn't have an MOT!!
Eventually after being fined etc, I was released and allowed to take the car directly home, then MOT it.
Moral of the story..... don't take another persons word for it! Like a mug, I still believed that a gentlemans word was worth something... my own stupid fault!
To top it all, I got home to find SWMBO waiting to give me her £5's worth of ear bashing for being a prat :-[
Rant over, going back into the big hole I've dug and not coming out :'(

It would seem however that there are more than a few for whom an observance of this trait is 'old hat' and something only practiced by mugs. To me, it’s indicative of how this consumer society, on its march towards the accumulation of money at all costs, has encouraged the worship of materialism and has, by doing so, placed the desire to put one’s own interests before those of others.
Irrespective of intent, it certainly appears to show negligence of the highest order by the former keeper.
This is very bad form indeed.
I would assume that there was no issue with insurance in the absense of the valid MOT certificate - if not, then perhaps you dodged one there?

I'm still bloody peeved though....I'd have bought the car anyway, got it MOT'd, then driven home. >:(

yes i would have been peeved aswell >:( but genuine mistakes do happen like this especially if you own more than one car i myself have got dates mixed up (might be my age tho) but at least the previous owner has admitted the mistake and made reparation :y

That is true to some extent, but for over a week I have been asking questions about the car and all was in order including the MOT. If your slightly unsure, you'd check surely?
Like you said, he has now admitted to the mistake, but it's me with a huge fine & points for the next 5 years!

I wish I'd known about that yesterday, I'd have double checked.... oh well it's done now, cannot change that :(
Maybe we could highlight this point in the cars for sale etc and hope no-one else is as stupid as me, to get nobbled, lol

if your selling a car with mot then yes you should have the document for it and if someone was travelling distance to come buy your car then you would certainly check.i still take a mans word as concrete but its getting harder to do each day and i have experienced the lack of that handshake before,at one time if two men shook on it that was stronger than a contract

I did, yep! He sold it to me for my estate, when in fact it was for a saloon! I seem to be drawn to cock-ups quite a lot recently! :-\

She's barely talking to me at the moment. It got to the point that if the car was legal, I would of gone away for the night. It was bad enough being dealt with by the police without having a grilling when I got home! ::)

I can still well remember coming home one night (1/4/09) and telling swmbo that I had got caught doing xxxmph on the M11.
for 30 years she had been saying "they will catch you and when they do...." I of course always replied "its not going to happen".
They love it when they are proved right. ::) ;D ;D

Very true.. but even the 250 post can't stop others being a bit "shady". At the end of the day though, it's not for the site to solely filter those out. We as individuals are totally responsible for any selling or buying we do and do so at our own risk!

No problems, car has no outstanding work needed on it, flew MOT only needing wishbones and droplinks. Air con is nice and cold and works, never really used it much. Tyres are all good with lots of tread left. Interior is immaculate, I wash it and hoover it out each week. Very minor points, the rear door passenger side lock doesn't lock with the other on the central locking, only started recently. Front bumper has some of the lacquer coming off in places, not noticable unless up close. All electrics work, thats windows, sunroof, mirrors, seats, heated seat elements front and rear. Everything that lights up does, if anything needed replaced i've done it, small niggles annoy me.
This is 10 days AFTER it had run out! >:(

Bad news and I do feel for you, Mate.
Don't wanna heap more misery on you but have you considered how much your insurance will go up come renewal?
Mine went from £500 to £2500 and that was without any points or accidents.
At least you still have the car, the Police now have the power to take your car too, if they want...

In all fairness to the Police they were really good. They told me that they can impound the car and leave me to make my own way home, but as I've never been in trouble, clean (was) licence they would cut me some slack.
That's exactly what they did...very lucky in that sense!

I can only assume things in Scotland are dealt with differently to England, with regards to insurance and MOT related offences.
Firstly, I'm trying to get my head around why the visit to the nick was considered necessary. In england, MOT and insurance offences can be promptly dealt with at the roadside in most cases, providing the Identity of the driver is confirmed. You could either be issued a fixed penalty, reported for the offence (court date arrives in the post), and vehicle seized.
Were you actually arrested, or was it a voluntary attendance?
Again, unsure of scotland, but in England and Wales, anyone stopped without insurance could have their car seized under S165 road traffic act.
A vehicle cannot be seized as such for no MOT in England, unless an officer (usually traffic) decides it needs to be prohibited from use for a specific safety reason.
It seems crazy that, they process you because they believe you have no insurance, but then let you drive said car home, uninsured, for 400 odd miles!
Most british forces now have a non-endorsable fixed penalty for no MOT. 60 quid and no points. If stopping someone for no MOT, whose insurance is otherwise in order, it would seem like two bites of the cherry to try and stick them on for no insurance as well...

I wasn't arrested, just cautioned as normal, lol. They were very polite and courteous. They took me to a police station as we were on the hard shoulder of the motorway and the station was only 5 mins away!
Whilst at the station, they asked me to contact my insurance to confirm I was covered to drive it home by them, which they confirmed they would.
Either way it's done now, just gonna have to bite the bullet and see what happens..... :(

Depending on how the matter now stands 'Viper, and irrespective of ignorance of the law being no defence, there are certainly mitigating circumstances here.
If you have been dealt with by way of a fixed penalty notice – which you accepted – or whether you have been reported with a view to prosecution I would certainly be making further moves to re-examine the ‘no insurance’ element of this situation with a view to ask the prosecuting authorities (and insurers) to re-visit this apparent problem of no insurance.
I say this because your insurers confirmed cover for the remainder of your journey from the police station; if they were able to do that in the circumstances especially in the continued absence of a valid MOT, then would they not have been prepared to confirm cover from the time of sale?
It may pay you in the long run to get some legal advice as there are extenuating circumstances here which may well give the insurers and the prosecuting authorities some room to manoeuvre in an effort to improve your situation.
I would consider the statement in that copy of the Email to be misleading at the very least.

Feel sorry for you on this one, well out of order, problem is I dont think you will have any defense as it may be said an MOT check can be carried out online within minutes, worth a shot maybe but I think you will be sunk, good look anyways.

It does not automatically devoid your insurance but policies say in the small print that you will at all times keep the insured vehicle road legal (or did, last time I explored said small print for legal purposes) and thus no MOT will introduce a get out for ins co's if they are called upon to say insured or not in time of claim or check by Police.

i was under the impression that it was "roadworthy" not road legal.that would mean that if you forgot to tax your vehicle then you are not insured, thats rubbish surely(they must do it differently in scotland i suppose)

The road traffic a t is the same throughout the uk, perhaps with the exception of Norn Irn.
My memory is road legal and not road worthy. It may vary between ins cos.
