Hi...
I have just received a parking charge for 'overstaying my welcome' at the Turbary Retail Park near Bournemouth/Poole.
This is a large car park (free) that covers a large amount of shops including Matalan, The Range, TX Max, Denholm Mill, Wickes, Brantano, etc etc.
The 'invoice' has a pic of my car entering and leaving the car park. Total duration 3 hrs 39 mins. I do not intend to pay >:( I intend to totally ignore all correspondence.
What I would ask....can anyone in that area take a couple of pics for me of the entrance (notices of parking restrictions), also any notices and and how many in the car park.
Anyone of you that goes shopping with the swmbo AND a daughter at shops mentioned will know that 3 hrs 39mins is a let-off!!!!!!!!!!!!!!!!!! Plus the fact that two of these shops have cafe/restaurants inside which we used (still have receipts). I don't know what the parking duration is for this retail park is, but it seems ridiculus to be short term. >:( We spent a lot of money there that day, so if anyone in the area can help it would be appreciated as help with my evidence if it goes to court. :y
Its the principal of being ripped off >:( >:(

I doubt for one minute it will go to court Tony, the leeching single cell life forms that issue those type of demands do not have the law behind them in the same way a copper or council employed warden has as they are private companies employed by the owners of the car park (think wheel clampers).
If they are going to take you to court then it would be a private prosecution, and one they would lose dismally by the sound of it (keep those receipts though bud).

To someone like me, who always pays car park fees, etc, and been law abiding to the best of my ability, its a bit of a shock to the system to receive one of these demands, with pics of my car entering and leaving.
I think I am going to write to Matalan and a couple of the others to see if they will cancel the charge. If not......we will see what happens :y

I don't think you'll get very far writing to individual stores as they won't own the car park in it's own right, there is probably a PO Box address (or similar) on the demand you received if you wish to enter in to correspondence with them.
As they have no power in law whatsoever, my attitude would be to simply file any further letters from them under B (Bin fodder) and not give it any further thought.
I'm off to go & do battle with Rushmoor Council now.
After paying the ticket the missus got last month for parking illegally (which we accepted because she did it), we got another one through the post on Friday claiming she had stopped outside a school. On this occasion however the warden claims he or she didn't have time to get the ticket on the screen and take a pic (which they have to do), so there is no evidence whatsoever.
Aside from the fact I know the car wasn't where the warden claimed it was, the missus has her own parking space at that school because she works there....so she would have no reason to park outside of the school gates anyway.
I am secretly hoping that this one does go to court, because I will take great delight in proving the warden is lying through his or her teeth and is simply trying it on in the hope we are the sort who get scared when words like "court", etc are mentioned.

Had one of these in November and the letters are getting more official looking and more threatening the latest saying my credit scoring may be affected ;D erm ..how?
The Mrs is cacking herself and is typically wanting to pay it, over my dead body!

Any photo or video evidence presented to a court has to be in it's original form, they aren't allowed to blow them up or manipulate them in any way as they would no longer be the original document ;)

Not stictly true, were possible the original should be retained to preserve 'best evidence'. However it is acceptable for the format to change and to even enhance the image, as long as there is a copy of a original and all the work is repeatable by a defence expert.
Just to nail it on, I'll cite computer based cases, if a computer has been used for a fraud, do they turn up to court with the suspects computer and turn it on in court to show what they have found? No, as not only is that against guidelines (although not impossible) it's not practical. Or another example, road accident on the motorway, someone is injured badly. Police are looking into it. Are they going to bring 2 wrecked cars and a section of Arnco to court? It's not happening is it?

Yep had one of these last year for overstaying my welcome in the local morrisons store,
The only advise i will give is ignore it unless it has been issued by the police or local authority it wont go to
court they cant take a car to court only the driver,The letters will get a bit harder but just put them in the bin

It really gets my hackles up to think that the car park is for shoppers use to shop at all the shops there. I was unaware you had to go to JB Sports to get roller skates before you could shop >:( >:( >:( >:( >:( >:( >:(
And its a FREE carpark, so what is the £70 charge supposed to represent ??? ??? ??? ??? ??? ???
Won't bother you with all tech stuff...but googling has given me a multitude of info on the legalities :y

The only reason these shits have been able to get away with it for so long is that most people can't be bothered.
In today's enlightened society however the tools to combat this banditry are much more readily to hand than at anytime in the past and people must use them to show these wide-boys just who really is in charge.

Not at all P, such tools are easily found in the 'positive reinforcement' category which, in turn, is part of plan 'B' - should such shits choose to ignore good sense and try to carry on regardless. ;D ;D :y

Hello, i have received the same charge notice as yourself for parking for too long at Turbury Retail Park on 30th December,it came this morning. What a joke.!! Yes i was there 5 hrs and spent money,it was the sales after all. Did not see any signs saying it was limited parking but i shall be driving over there tomorrow for another look. I will let you know my findings.

I have also today received a paking demand for this car park for my visit on 31/12/11. They say I was there 3 hrs 40. I will be in Poole this weekend so will gather whatever evidence/ photos I can then review the situation and consider my options - I strongly suspect payment is a very unlikely outcome!
Will feedback my findings.

I think most of you will gather that by the times given as being in the car park, the amount of 'free parking' has been deliberately set low to catch people out. >:(
As I said in my OP, if browsing/shopping as most women do, and not just going to one shop for a particular item, then over 3 hours there is pretty normal, if my wife is anything to go by. All I can say is I'm lucky it lasted this long.....it won't happen again. ;)
Just shows...three of us from this forum alone that we know of...wonder how many others got done too :o

Got this t-shirt, or very similar. I took two spaces in a b+q car park. Parked as far away from the door as possible in a usual "don't ding my car" way, in a car park that was barely 20% full with very small bays. I was there about 5mins.
Returned to find a ticket demanding £60 for not parking within the white lines.
But no matter, the reason is immaterial. As said there is no legal obligation to pay ANY parking fine issued on private land. Satisfy yourself of that with some research, but I would like to assure you no further attention should be paid, don't waste your time any further with it other than to throw the letters, which will look inreasingly official and intimidating, DIRECTLY IN THE BIN!

I'm not actually an Omega owner, but did a Google search to see what might come up about this subject.
I too received a notice a couple of days ago, for overstaying my welcome at Turbury Park on 30th Dec. So yesterday I drove back there to check out the signs. There are loads of them, including one right at the entrance (see links below and zoom in on the pics).
I made the assumption that the main purpose of the 3 hour parking limit was to stop people from parking in the car park then clearing off somewhere else; so last night I sent a very polite email to the address quoted on the back of the letter (tps@appealpcn.co.uk), attaching a photo of all my shopping receipts to prove that all I'd done during my stay was shop and eat on the premises. I apologised, told them it wouldn't happen again and asked if they would be willing to reconsider their decision on this occasion.
This afternoon I received an equally polite reply back saying they had cancelled the notice. Maybe I got lucky; but I reckon that, as long as you're polite and can prove you were in the shops for the whole time, you're in with a chance.
For the record, if they hadn't let me off, I was just going to ignore their demands, but it's much less stress and hassle if you can avoid going down that route ;)
Whatever you decide to do, I wish you the very best of luck.

i love giving out the pcn`s... especially to those who park in the disabled bays and parent and toddler bays... oh and those who seem to think its ok to park on the footpath..... but i especially love having to hear the hard luck stories and excuses.... as for not paying them your choice mate... i dont care cause i just post them off at the end of the week and let head office worry about collecting the fines for the landlord.... oh and i`m not joking guys i really do give out pcn`s.... :) :)

When I am in a car park (albeit one that is fuller than 20% full) and see this, I will often park next to the 2 space offender but try to get my car in between the lines. In doing so, getting extremely close, making it difficult for the car driver to manoeuver out. Certainly ain't gonna be to open the door on that side. Ok, before you say it, I run the risk of a scratch. I must confess to having bigger things to be concerned about.

i generally take two spaces in the van..i have always managed to get out thats what bumpers are for ;D ;D but if someone takes two spaces in an near empty carpark shows they respect their car.......its just unfortunate in todays society you will always get some bell end park next to you
i always park away from a shop trolleys on wheel and a walk no problem but always seem to find a bell end who has parked next to me :o :o

Just ignore everything they send to you. They have to prove a loss. As the car park was free there is no loss. The letters will demand you say who was driving etc. Ignore the lot. As said before the bin is the only place.

I got similar for staying 4 hours in a 3 hour limit car park, just ignore the letters, don't respond to them, don't right to them. It will cost them to take you to court and for what? No loss of earnings as its a free car park.
They will try and scare you with all kinds of bull, just ignore :y

Yeah, I've had one too. Cannot remember the company name but they were on Watchdog. The advice there was to bin the letters. Apparently they even have a fake debt-collecting company who will try to scare you into paying the money.
As long as you caused no damage to the property the most they can ask for is a percentage of £0 = £0. Not got a leg to stand on so no chance of going to court.

From memory I think you get 6 letters, then the fake debt-collectors and then they give up.

I think you avoid any kind of contact as otherwise you might be implying they have a case.
