If a front track rod end is excessively rusty, will it fail an MOT?

Last time my local MOT gave me an advisory on MOT saying they were not adjustable, but I didn't think they needed to be for a MOT?

One side is ok, but drivers side for some reason is mega rusty. Wondering if a coat of black hammerite would do it, although tad obvious they would have been rusty  ::)

Before I took my TD to WIM, I removed all four, and slackened and greased them. Made life simpler and they were now adjustable. :y
