Following a death .........

Please can somebody who knows advise exactly what happens following the death of a council tennant regarding advising a council, how long you have to clear the property etc.

MIL passed away yesterday following several weeks in hospital. As it happened on a friday we have a couple of days to focus on other things.

A difficult period now ended ............

As the rent is effectively payed a month in advance, its normally around 28 days.

Tbh rob, i'd just sort out the funaral and other bits and bobs first, clear the house and then hand the keys in at the local rent office when finished telling the clown behind the counter that the tenent has passed away and the property has been cleared of any personal belongings.  That way, you won't get some jobsworth quoting the rules and regs book at you at a time when you don't need it  ;)

When my FIL died I contacted the council and asked that exact question ... the answer was quite simply, "14 days after the paid up rent period" .. and your FIL has paid until .......... but we don't normally chase for a while after that, sorry for your loss, if we can help just call us"... and they were as good as gold, even advising us on some house clearance companies...

I guess it depends on who you talk to .. a "jobsworth" or someone with a modicum of compassion ...

Thanks all.

SWMBO and her sisters are working through lists of things that need to be done - this is obviously just one of them. Gas/Electric/Water/BT/Council tax/Pension ....... the list goes on and on.

The council were actually very helpful when FIL passed away so don't really expect a problem. They have been tennants since the flat was new in 1955! FIL insisted on paying the rent by cheque in person. MIL continued with this after he passed away, only switching to DD in the last few years when the journey became too much for her.

Our eldest went to Afghan yesterday - but managed a 300+ plus round trip after work on Thursday to see his Nan - which she was really pleased about. At the end it was all peaceful and dignified, surrounded by caring family. Everyone is totally exhausted as this has been their focus for a few weeks now ..............

You have our deepest sympathy, we have just lost the Father in Law on the 6th and to be honest the house is the last thing you want to worry about but unfortunately in the case of Birmingham City Council they gave us about 10 days otherwise we would be billed for rent @ £86 per week.
Because of a holdup with the coroner we had actually cleared the house before we had the death certificate because there was no way we were going to get caught for a rent bill!

In our case, it was 1 month, although that may be because that was what it was paid up til.

Ok, an update.

All I can say is that I am glad that I'm at home and not involved in the detail down in London.

Barnet council have advised that unless the flat is handed back by the 3rd that another months rent is due - as that's when it's paid upto. No leeway/grace period for clearance at all.  :(

SWMBO & her sisters are getting stuck in and are determined to meet the deadline. Not the way that I'd want to do it - but not my choice either, so have to respect that ...  :-X

Yet again, seems that there are massive differences around the country ......... Why on earth can't they standardise ?????????????????

Had similar situation with Derby council but they were great, take what you want then drop the keys in and we will clear the rest. Some council staff are shitheads .....end of  >:(
