Glad your OK… Last week I went off the M40 at junction 4 at night and on the slip road I had to swerve to avoid a deer that was just standing there looking me… luckily he was looking straight at me, their eyes sort of glow in the headlight, so I saw the eyes before the rest of the animal (their brownish colour does not help making them visible at night).

My poor mechanic hit a deer at around 60mph. Trouble is, he was on his bike... ...taken to A&E in back of ice cream van with blue flashing lights....

You've got my sympathy there mate, but glad to hear you're ok. My journey to and from work takes me through parts of Hatfield Forest and deer are always running out on the road. I've seen quite a few of them hit by cars over the years and they certainly make a mess of them.

Sad news James.

Last time I saw a deer it was eating grass at the side of the M6.  First and only time I've called 999.

An Omega may only be a 3* NCAP but the point is you walked away - unlike the stupid deer  :-[

The Omega is built like a tank, and the metal re-inforcer behind the bumper is like an RSJ - there is not mega damage to the car. It needs a new wing, and a few bits, but it's do-able.

Re. the law re. the RTC - having checked it out purely out of interest, the breath test+producer is apparently only policy when you hit something such as another car, a person, or someone's property = it doesn't apply to simply hitting a wild animal!!

Sounds to me like you may have a reason for a complaint against the police for how you were treated.

There's also a law that makes it an offence for you take the deer to the butchers - but the car behind can without issue.  So getting a producer seems par for the course.  :-?

Unlikely you would have a claim against a Police Officer doing their job correctly!

Whilst the road traffic act defines a "reportable accident" as being what you have described, the term "accident" is much looser and could be interpreted to include your unlucky experience. The point is "Would an ordinary person describe it as an accident". The courts have deliberately not defined "accident" to cover all eventualities.

It is perfectly acceptable to issue a producer and inspect tyres on a car merely for its prescence on the road, no accident required.

Anyway, as long as you produce your documens then everything is all ok.

Glad to hear it is not too badly damaged
