oil level marks

I believe a 2.2dti has a 5.5 oil capacity, but when doing a an oil change I very much doubt if every last drop comes out. I normally top up initially with 5ltrs & add as required. after recently having the sump lowered & dismantling the balance pump to enable me to slide a new sump gasket on then filling a 5ltr can which only just showed on the dipstick, I then topped up with a measured 1/2ltr which has only taken the oil to halfway up the dipstick. ( did let it settle overnight ) this is my theory when doing a normal oil change whatever is in the balance pump will always remain so, & because I took it off hence emptying it the capacity will be nearer 6ltrs. as the dipstick is our only guide should I top up to top mark ?

Always fill to top mark on dipstick
  its up to its mark but still have low oil message. on replacing oil pan I was underneath putting the bolts in hand tight mainly working on the o/s & just feeling my way mainly on the n/s. I did trap the sensor wire but as the oil pan was only on hand tight I at the time dismissed the thought of damage. also I did check & there was no visible sign of damage.
