PAYPAL- Holding my Payment from buyer!

Just sold my old Ericsson X1 on ebay and the buyer has paid via Paypal i recieved an email off paypal saying that ive recieved money but theyre going to keep it for abit! 21 days to be precise or until buyer leaves me feedback!

Im in two minds weather to refund the buyer or have some fun and Sue paypal for the money i know i'd win via the Small claims route as any reasonable judge in the country would rule this as unfair clauses

anyone else had a similar experiance ive also noticed ebays own policy contradicts paypal by saying " Sellers should only release goods when cleared payment is recieved & processed" as paypal have held the money i dont see this as a cleared payment

I got this load of poo by email yesterday:

On the 28th July, 2009 we informed you about the new faster and easier dispute resolution process on eBay. You can read the full announcement here.

Buyers will be able to resolve their problems on eBay through eBay Buyer Protection. We intend to make this process available to more and more buyers throughout 2009; although initially only a limited number of buyers will be able to use this process while we make sure it's working for everyone.

To reflect this change, the eBay.co.uk User Agreement will be updated.

eBay Buyer Protection

Under the eBay Buyer Protection Policy [v1], if we resolve a dispute in the buyer's favour, we may:

 remove funds from the seller's PayPal account to reimburse the buyer for the costs of both the item and original postage fee. This is in accordance with the seller's authorisation provided to us under the new User Agreement [v2] ; or,
 where there are insufficient funds in the seller's PayPal account or where PayPal is not the reimbursement method of the seller, directly refund the buyer for the cost of the item and the original postage cost. In this case, the seller must reimburse us in full in a timely manner for an amount equivalent to the sum we paid to the buyer.

Sellers must have a reimbursement method on file with eBay at all times. The reimbursement method can be changed by contacting eBay and searching for 'Change My Reimbursement Method'. Where the seller is found at fault, we will notify them and charge the method of reimbursement they have on file.

Changes to the eBay.co.uk User Agreement

The new User Agreement is effective immediately for new members registering on or after today, and from 23rd October 2009 for current members. You don't need to do anything to accept the new User Agreement, but if you don't wish to accept, please, follow these instructions to close your account.

friends of mine has had the same problem i think they do it with most electrical goods just to make sure that the item is working correctly in accordance with the listing. good if buyer bad if seller

yep this has happend to me too with an N96 ive had to ship to ireland im pretty ancious (sp) about it becuase the buy could leave bad feed back then i will loose the item and the money !

id doubt you could sue ebay as there based in luxemburg so they are only obliged to follow the rule of the country there in IRC

Paypal has a UK address aswell the luxembourg nonsense is to avoid HMRC i think! look them up on Companies house they list a building in Surrey

i have decided not to send the phone despite ebay insiting i do have attatched the email off them below for your reading

That is outrageous but a sign of the times we live in.

Presumably there are lots of dubious "sales". Reminds me of a fellow on another car forum who openly admitted selling none working parts as worked Ok when removed from car.

LOL, how many times do I have to say it - DO NOT DEAL WITH CELLPHONES OR LAPTOPS ON EBAY


They are perfectly entitled to do what they say they will, in fact I believe you have to go through this extra step when you list it to confirm that.  Its your choice to use them.

Believe me, you **WILL** get scammed if you don't follow my advice above
