What the small claims court?

Worth a try - they took your car off you so they shuld pay for it >:(

I completely agree with you. But unfortunately I have my doubts as to whether you'd get anything even if you won.

If his parents have reasonable house hold cover then that should cover it......

Was it a stolen car........or was it a driving with permission....or what?

it was a stolen car being pursued by the police, basically came round the corner of my street at 40 hit the curb opposite house and bounced into my back end pushing the whole rear end round so looks banana shaped. multichanger spued its guts all over the path

MIB (Motor Insurers Bureau) usually settle claims where an uninsured driver is involved, and then try and reclaim the money.

MIB was established in 1946 as a private company limited by guarantee for the purpose of entering into Agreements with the Government to compensate the victims of negligent uninsured and untraced motorists. Every insurer underwriting compulsory motor insurance is obliged, by virtue of the Road Traffic Act 1988, to be a member of MIB and to contribute to its funding

If it was involved in a persuit and the Police have decided not to prosecte do they not have a payout scheme - after all your car did stop the chase and bring it to a safe, if unahppy, end.

Something I'm not catching on to here.....

Was the cherub identified or traced at the time or is it an ongoing enquiry?  Guessing he/she was traced at the time and locked up.

If driver was 16 then he/she is (certainly up here) an adult and goes to adult Court.  Under 16 then its the Childrens Reporter or Panel.  Either way, still gets done.  

Driving a stolen car - the stolen car should be insured by original owner and unless 3rd party only cover - rare nowadays, 3P F & T the norm - and should cover damage to yours.  If not, then thats what the MIB is for.  You probably have some sort of DAS or legal protection scheme with your own car insurance or indeed house insurance, so use that to get things rolling.

No prosecution?  Going on the circumstances you relate, can't see why the little cherub is not getting done.  Would suggest contacting the home Force and requesting an explanation of their actions as you are an injured party (or your car is) and you are intent on persuing the recovery of uninsured losses due to their (Officers) actions.  Send all mail recorded and keep copies.  Least that should be forthcoming is the identity of the driver so that you can recover losses.  May need the payment of a fee, though.....  Data Protection Act gets soddin' everywhere....

well update on my empty life without my beloved 6 pot elite. insurance is paying out now and i was originally looking at a r reg 2.5 cdx v6 but a lovely elite 3.0 just came up and hopefully will be getting it for the right price.
i left school and started an apprentship at dixon vauxhall in hull and passed my nvq so became qualified vx tech and the first time they let me loose in a elite i was hooked. KEEP YA PORSCHES ETC IM AN OMEGA OWNER AND IM-

LIVING THE DREAM!!

lol thanks for all the support about mib and all the advice of what roads to go down with my insurance, paid off.
