Catalytic converter

My  omega  is due for a Mot soon and the down pipe before the catalytic converter is holed ( about a 10p size hole ), it is not blowing as it's double skinned,it was like that at the last Mot and it passed with the tester commenting as long as the inner skin was not holed it was fine, my question is can i patch up the outer hole with gun gum ( or similar ) and still pass or do i leave it as it is ( i tried to fit a metal exhaust band that halfords supply but the pipe has raised edges ) im worried it might start to increase in size if left to long, any thoughts  :-/

its just a heat shield. on my v6 they were falling to pieces so i removed them and it passed its mot with no problem.
