Absolutley Stunned!

Okay lets call this "right to reply"  

I have had to advise this individual to go through the proper process to claim a refund - which he refuses to do.

I have already offered via paypal to refund but had no response.

I have had 1 negative in a year and over 500 positive feedbacks in that time. Anyone wanting to be impartial to the sellers lies should look at my feedback

I have been intimidated and threatened over email by this individial and forwarded the threats on to ebay. As ever they will probably do nothing as sellers are blackmailed by buyers.

This is why i have told the seller to stop communicating with me if he cant communicate in an adult way and non abusive way.

I frankly despute that this item is the same one and hence why i want it back.

Maybe i should also wash my dirty linen in public by publishing your emails. What do you think ? No sory not doing that i have more class.

Also intresting that the "buyer" has choosen to involve a medium that was never involved for the orginal transaction ( ie oof) and futher concerning he decides to do this for exposure when there are no admins on the correct the error of his ways.

Yep there is indeed two sides to every story and this is frankly a horrible threatening little man to deal with.

I wont be adding to this comment.

Looking at the terminology used i will be taking further advice on how best to legally deal with this individual and some of the comments. I suggest there are no further comments added.




If you read back through my previous thread you will see i included all email corespondence between us so as to give the full picture - STOP CALLING ME A LIAR - i have not lied but shown everyone what happened if you can't handle the truth it ain't my fault 'big' man ;)

I'd agree that to a large part running around screaming in forum isn;t particularly helpful....

nor is the whole "foaming at the mouth" bit on the part of either of the participants.

I do however feel that the dispute is relevant to forum users interests.

My comment , in direct response to Markie's "comment"  which was unfortunately locked out by the locking of the original thread....    went like this...

I have a new, much lower opinion of Markie, brought about ENTIRELY by Markie's own words,  but Hereford isn't really helping his own standing either.

The reopening of the subject, despite admin lock down, of a dispute , in emotive terms, and being of potentially defamatory nature , is a little immature....  and not a means of resolving such a dispute, indeed, it's almost certain to entrench positions on either side of it.

I have already said all i have to say on this.

Clearly writing something in red or blue and putting quotations on it does not represent an audit trail from my own ebay id.  ::)

I really stress again that some of the language used  again and consistantly is potentially inviting legal correspondance.

Such is my anger at this i will leave the forum. I really do not need this sort of abuse.

If the OP believes his harrasment  of me via email over the last 2 weeks indicitive of victory so be it.

OK.  I have read substantially more than enough....     >:(

I can see both sides to this episode and emphasise that I take no side, other than that of the OOF admin trying to create sense out of apparent mayhem.  

I again make the following comments.

The sale was conducted on e-bay, not OOF.  Indeed, the item was not even offerred for sale on OOF.  E-bay has assorted processes whereby persons in dispute can resolve, whether you agree with the mechanisms or not.  Consumer law applies and thus the correct route to remedy this must be taken.  That is not OOF.

Whether one/other/both involved in the matter is/was a member of OOF has no direct bearing on the matter, nor does the level of postcount of those involved.

Bear in mind that the use of certain words in a medium such as the internet can be considered defamation.  Heres the Wikipedia definition of defamation....

In law, defamation (also called vilification, slander, and libel) is the communication of a statement that makes a false claim, expressively stated or implied to be factual, that may give an individual, business, product, group, government or nation a negative image. Slander refers to a malicious, false, and defamatory statement or report, while libel refers to any other form of communication such as written words or images. Most jurisdictions allow legal actions, civil and/or criminal, to deter various kinds of defamation and retaliate against groundless criticism. Related to defamation is public disclosure of private facts which arises where one person reveals information which is not of public concern, and the release of which would offend a reasonable person.[1] "Unlike libel or slander, truth is not a defence for invasion of privacy."[2]

Desist  in the use of such terms on OOF.   >:(

Again, I will lock this thread as open forum is NOT the place to resolve this, it has nothing directly to do with the sale, and could easily render posters liable to potential legal action and by default, involve OOF as a whole.  Remember what happened to the Volvo forum recently.  It had to close for a while pending expensive legal and Court representations...
