Right had a call from BMW's accident exchange people on the phone today regarding the accident that occured, the bloke who hit me and the company are totally denying the accident so they said that they can do nothing about it. No way am I making a claim on my insurance to get it sorted! Where do I go from here?

If I tell my insurance comapny and they fight the case will this be classed as a claim?

I can't comment on the legalities or the Insurance side of it Del, but one bit of advice for now & the future. ALWAYS carry a camera in the car, preferably on that takes movies like the the RoadHawk. As your experience has now proved, it is a small outlay in relation to what it could potentially cost you! I hope this goes your way, & everything is sorted soon mate

Well it's over £2000 worth of damage so no way is my insurance going to pay for it, nor is my premium going up because of something which was totally not my fault.

Sadly Del this is the way people work, you should have involved the police immediately saying you had been forced off the road.  :-/

Regards the claim, the best people to advise are your insurance company themselves.

Yep, as said, your insurance company need to fight this.....your probably already breaking the policy rules by not reporting the incident to them

You only lose your NCB if the claim was your fault or partly your fault.

If you have paid for Legal Expenses cover, your insurance should take the other party to court to recover costs and repair to your car.  If witness is independent (of you) they are very useful.

If you don't have Legal Expenses cover the Small Claims Court is open to anyone but takes a bit of effort and you need to have a case.

Many bluff and deny but cave in when faced with court.  (Not that I've experienced 'many').

Yes but it only affects your NCD if they say its your fault or go knock for knock with the other parties insurance company.

Depends on how much your premium goes up buy if you lose as opposed to cash value to repair the vehicle.

Yeah im waiting on the Mrs renewal coming through when i ran in the back of a blatant crash for cash scam earlier in the year. I took pictures there and then of my vehicle and the other parties (NO Damage to there car at all) A little tap at 2mph didn't stop two cop cars and three ambulances turning up for the serious RTA that had occured

Waiting on my insurance company fighting it as they said it was clearly a scam just have to wait and see, i know the premium will go up if its still an 'open' case

I don't know if it will be the case in your situation, but I got run into a few years ago (whist I was almost stationary) by a delivery driver reading a clip board at the time . My insurance company suggested I may want to accept partial resposability WTF she ran into me. It made me wonder about the agenda, both parties share the blame, two drivers have there no claims bonuses and renewel premiums affected Kerching more money for the ins. companies
