Problem I have

Any of you guys had any experience with Trading Standards, wife has a brand new car and it aint what we were told it was.

No guarantess or warranty with it then?........you could always pay the dealer a visit with Sammy :y

got all that mate, its a brand new clit 197 sport, import, great car, told it was UK spec, found out there are a few things not on the car that a UK spec has, we were told it was a fully UK spec many times.
goods not as described and all that.

Kinda been misled then >:(,...... I think some kind of refund may be in hand, also worth checking out which magazine website, I subscribe to their legal service / advice aswell ( not had to use it yet though), but very handy just in case. :y

Just found out some info from the web page AA sent.
Section 13 of the sale of goods act 1979 (As ammended) sale by description, items must be sold as described or otherwise advertised.

You have rights there, even if it was an import  :y

Slightly different but the same rights......

M8 of mine bought a Merc SLK from a company brand new....not from an mec dealer tho....he'd had it nearly a year when he took for a service at a merc dealer.....they told him he had an import.....he was never told it would be an import.....so he went back to the company...short of story, he got offered £8k to keep the car.....so he did  :y

So if you wanna keep the car......go for a part refund  :y

do you have adequate proof apart from verbal that you were guaranteed full uk spec, explaining what your car should have that it turns out its not got?

when choosing the car, were there certain things you requested that you haven't got?

have you given them sufficient time to rectify their mistakes?

obviously for insurance purposes you need to know for certain that your car is UK spec!

Tha sales manager sold the car to us, he read down a list of everything the car had from one of their brochures, which I have. There was no alarm fitted, cat 1 & 2, I questioned this part when he came to it on the list and was assured the import is as this UK list.
I have given them 3 attempts to fit an alarm since 17th April, the engineers now say they cannot fit one as the ECU is not UK spec.
A letter has been hand delivered to them demanding all monies back as the car was misrepresented to me.

to my knowledge you'd need to send any correspondence of that sort by recorded or special delivery so that you have proof of it having been delivered ...

keep a record of all docs you send, and send recorded delivery

Thanks for all your input Lads  [smiley=dankk2.gif], they have till Wednesday to answer the letter, or Trading Standards will be visiting them and I will be taking Legal Advice.
