Advice needed, a tale of woe!

Hi guys, long time no speaky, have been really busy with one thing and another.  But once again am looking for your advice.
As some of you may, or may not know I had to part with my V6CDX mega recently due to running costs, needed something more economical for the foreseeable. Logged into www.swapz.co.uk and put the mega on the site, was offered quite a few cars but settled on a 2ltr Vecy estate. The owner told me he had the history for it, was going to put a new MOT on it, and had the receipts for a full engine rebuild done by a main dealer, and in his add for the car he describes it as immaculate condition inside and out. My wife called the guy 4 times to arrange a mutual exchange, the guy seemed really genuine over the conversations on the phone. Told him that it was to be out family car and he gave his word that there were no major issues, and he had just put 12mths MOT on it. He said that he had kids and would risk his own kids in a dodgy car, and of course would exchange a dodgy car with someone who had a family to transport about. He said the AC could do with a regas, but I though with summer drawing to an end it wasn’t much of an issue.
So all is good so far, and we went to meet the guy Saturday morning still happy that he was genuine. So we drove up to Grantham services to meet the guy as it was halfway between us as the guy lived north of Lincoln, and there was the vecy. First thing I noticed is that the alloys were not on it, in the pic it has Sri alloys on it. He apologised for this explaining he had taken them off weeks ago, but on the up side had put 4 brand new tyres on the car, which was true.
I look at the exterior, few scratches, few tiny dings, but nothing that I couldn’t put right as Im fairly good with paint work.
So anyway picture the scene! Met up with the guy, looked over the car, my 13mth old son is screaming his head off as he is teething, the wife is stressed, Im wanting to get sorted and back to MK fairly sharpish so I said to the guy.
“Look mate, I need to get a move on back to MK, so Im a happy man if you can give me your word that the car is ok, and has no problems bearing in mind im transporting my family in it”
To which he said “I wouldn’t lie to you mate, you have my word that its fine for your son” offering a hand shake which I accepted,  and took the guy at his word. V5,s exchanged and off he went with a wave whilst I got the baby seat sorted out and fitted in the vecy.
Personally if I give my word to someone it’s my bond, and that’s one of my very, very few morals. Stupidly naïve of me to assume the same of most people.  

The dash display had about 2 pixels working, only a few of the dash warning lights worked, and no illumination on the odometer, although the wife had been led to believe it had about 80K on it. Yes it had 80k on it since the engine had been rebuilt in 2001, but once I got the odometer in the right light it showed 175k on the clock!
Instantly called the guy on his mobile, and was ignored!
By the time we had arrived home the exhaust manifold was blowing, on inspection it was stuck together with exhaust sealant.
Driver’s side rear wheel bows outwards, and when you rock the car makes strange suspension noises.
Rear load cover had been ripped out by the mountings.
The grill was smashed, but had been made to look ok.
To my horror I realised that the radiator and the fan were not mounted at all, and were rattling and boogying about in the engine bay, which also has an array of split breather pipes.
One front driving light out, one rear fog light out, blowing exhaust, crabs under heavy breaking suggesting serious problems with the car.
The MOT was only 3 days old, how could a car like this pass an MOT? Let’s face it, with a fog and a driver out, as well as a blown exhaust it just couldn’t pass a legitimate MOT.
So now, through being trusting, and taking someone at there word I have a vecy with a dodgy MOT, 175k on the clock, a dancing radiator and fan, a crabbing back end, and god only knows what other issues saying as the MOT appears to be dodgy. The place where it was MOT’d will be getting a call first thing Monday morning.
It’s sat outside, and will not be used as it is blatantly unsafe, and worth scrap money, leaving us without transport, and as some of you know transport is a necessity with my little boy.
Have tried to call the guy 8 times yesterday, no response so he is plainly ignoring me.
There are those that might say, ‘well its your own stupid fault’. Or ‘should have looked closer’ type of thing. The bottom line is that being a trusting type I took the guy at his word.

What course can I take with this?
Do I have any rights bearing in mind it was an exchange of vehicles?
How do I stand legally?

Any suggestions would be greatly appreciated fellas

Sorry to hear this Owen :'( I feel for you mate, another dodgey motor :( Get on to VOSA about the MOT, that should get them sorted and you can try the police if you have the blokes name and address, but i am not sure how much interest they will take >:(

Dont recon the old bill will be that interested either, but its worth asking them

I would, tell them you think its a Ringer, that should provoke a response and hopefully a inspection and follow up.

Another little twist we have just discovered sitting here going through the vecys paperwork!
The the blue part of the V5 which I had in my hand, with his details on it, is not here. I had it in my hand once he had filled in the details, I assume he has taken it back whilst I wasnt looking.

I really feel for you mate 0 thats a shocking situation  :'(

A quick look under the bonnet and by casting an eye inside may have alerted you to some of the issues before an exchange.. However thats hindsight  :(

...hopefully this will stick with other members and if theres any good its that someone reading may learn.

I would be trying to contact the DVLA and MOT test centre about this and would not be using this - sounds to me like its had a realy bad shunt - twisted chassis.

What a shocker, sorry to hear about the 'swap'. As been said get the DVLA onto the case and they will be able to tell were the 'M.O.T.' was done. They in turn will be able to see if the owner was the one 'selling' the car.

I know you can say beware of swaps or money changing hands but this is an out and out con. How can some people sleep at night given this sharp practice?

Sorry to hear about this...

I bought my cars so far from dealers, but from what I read this is exactly how you shouldn't buy a car, i.e. meeting in motorway services etc. Still, you made an honest mistake and trusted the guy... which I guess proves that conmen are very good at gaining your trust.

I suppose the MOT station is too far away from you to actually go there yourself and confront them? If you intend to take any action on that account e.g. complain to VOSA then you need to act fast, or the MOT station will say 'it was fine when we tested it...'.

Worth going to see the police about it for their advice... this guy is very likely to be a trader in disguise, flogging-off bad cars. Sadly i argee that they may not be too interested (they don't seem to interested in almost anything these days, see: http://www.dailymail.co.uk/pages/live/articles/news/news.html?in_article_id=481747 ).

The only good news i can give you, is the Veccies only have one rear fog light, afaik. Both my VeccyB and C used to only have the offside one working even tho there is a nearside bulb holder and bulb fitted. (Presumably for LHD versions)
And they used to pass the MOT like this.
Front headlight bulb 'could' have just blown  :-/

However it does sound as tho it has other major issues.....that certainly should of failed the MOT, loose radiator being one.

I think i would get it MOT'd again ASAP to see what is wrong with it.

I thought fake MOT's were a thing of the past, with computerised printouts  :-/

Tho remember the road worthyness of a car is at the time the MOT guy inspects it......not a day/week later.

But does sound like you've been 'had'  >:( >:(

1 last thing, after a realy close look the car pictured in the advert, I dont think its the same car I have sitting outside! Certain marks are missing on the pic, and the GLS side badges are not on it in the pic either, as well as the one pictured doesnt have a broken grill!

The plot thickens >:(

Number 1. He is a dealer. Look at the picture, dealer stickers on it.

That changes a lot. Contact trading standards tomorrow morning. Give them al the information you have. Contact the police if you wan't, but this is not a police matter unless you suspect the car is stolen.

With that sort of mileage the car is worth about £300 in an auction, less the problems.

The fact that he IS a dealer may help you here, but you won't see your omega again.

Sounds like a nightmare. You can get his address from DVLA once he registers the car, but only if he does! If he sells it on you still won't know.

Not much concellation, but NEVER buy anything unless you have the sellers actual adress with verifyable telephone number.

If I were you - report the car and log book stolen.
Honesty is usually the best policy but in this case you have a limited amount of things you can do.


Unless you have a few "heavy's" on stand by that is, putting the fear of god in people always works.  :y

I dont think Trading Standards would help because it wasn't a trade sale but a swap so its probably beyond their power to act.

If I were you, I think I would go to the Police as this is clearly a criminal matter.  Firstly, the guy has commited fraud by pretending to be the owner and/or registered keeper of the vehicle when he is, in fact, a trader trying to dispose of an unroadworthy and possibly illegal vehicle.  Secondly, as you rightly say, something does not add up about the car (faults aside for the moment) which could mean its either stolen, an insurance right off or a ringer.  If its stolen or a ringer the guy is guilty of handling stolen goods (his actions suggest he knew what he had), if its an insurance right off then again its fraud.

As far as the MOT is concerned, either he has directly been involved in forging the vehicles details or knows the people who have. Either way I'm sure the police and VOSA would be very interested to hear about it.

One last thing.  If it were me, I would report your Omega as a stolen vehicle.  This guy has delibrately defrauded you out of it and technically that is theft.  It may also stop him disposing of it before the police can intervene and you may get it back.  (Long shot, I know but at this point I would say you have nothing more to lose)
