A question about driving licences

As some on here know, the clever shit  lad passed his driving test yesterday  :y

He has had his own car and own insurance policy for that car since day one which is about 9 1/2 months ago now.

Under the rules of that policy, if he passes his test after the 10 month mark, he is entitled to 1 years NCB  :y :y
Also, under the terms of the policy, he has to cancel it when he receives his new (full) licence.

Right, yesterday, he sent his provisional licence off to DVSA  :y
Also reading the back of the certificate he received, it clearly states that it is NOT a licence.

Okay, am I right in thinking that until he receives the full licence back, he affectively has No licence ?
Also am I right in thinking that since he hasn't received his full licence, he is under no obligation to cancel the old insurance policy until he receives the new licence ?

If that's so and we can hang the bag out for 2 weeks then in theory, he should be entitled to a full 1 years (30%) NCB when he insures the car again ?

Advise off the plod on here or those in the know most welcome  :)

I would have thought that now he has the piece of paper stating he has passed his test, that he now has a full license, even though he doesn't now have the actual license in his hand!

I would think that as licenses can only be issued and revoked by DVLA or the courts, until DVLA issue a full Licence his previous provisional one would remain in force (till it is revoked/superceeded).

I also think it's asking for trouble allowing him to drive un-supervised and without L plates on his current insurance which appears to say it's invalid once he's passed his test.

Its not worth the risk of falling foul of the law,last thing a new driver needs is penalty points.

Slightly aside from your question you posed - have you actually checked up on insurance cost for the lad? Reason I say is because upon me passing my test, my insurance quotes skyrocketed. Reason being as a provisional driver you always (should) have someone in the car with you as supervisor, soon as you're a newly qualified driver, of course you're then able to rive around and running ver old grannies as much as you like. Hence the quote goes up. I know, it's counter-intuitive rubbish, surely upon passing your test you're driving at a higher standard than you were, say, 6 month ago, but the insurance companies don't see it like that, sadly.  Just something to be aware of.

As a 'PS' I actually didn't drive for a year after passing my test for that reason. However, your lad's got 1 years no claims, as you say, so hoping you're not stung in that same way.  :)

Has something changed recently then as it used to be:

After your test, your examiner will give you your pass certificate. You can use this as evidence that you have passed until you get your photocard driving licence, but you actually don't even need to carry it with you.

And

Any learner driver insurance you had does not cover you as a qualified driver, so you need to call your insurance company to change it (if you want to stay with them), or arrange new car insurance.


Both of my two drove straight away on their own after passing their test but they were both insured to drive my car regardless of full or provisional licence, so it was straightforward for them.  :y

RTA83 States -

Can you drive before your licence is returned?
Once DVA has received your valid application, the law allows you to drive before the licence arrives as long as you:

have held a Northern Ireland or Great Britain licence issued since 1 January 1976 or another exchangeable licence
are not disqualified from driving
haven't been refused a licence for medical reasons or for failing to comply with medical enquiries
wouldn't be refused a licence for medical reasons (if in doubt, check with your doctor)
keep to any special conditions which apply to the licence

As soon as he passed his test you need to tell the insurance, just lets say he has a bump the insurance company would easily wriggle out of that if you don't tell em. I.e.

"Oh sir I see you are a provisional driver, who was supervising you at the time???"
"Errrrrrrmmmm???"

Or

"Oh you never told us you passed ya test, you're not covered!!"

Don't think the license bit is the issue here, if you don't tell the insurers you'll be in trouble.

Once he passes the test he becomes a provisional licence holder with a pass certificate.  He should advise the Ins co of his test pass ASAP and not wait till exchange licence is received.

He only becomes a 'full licence holder' when he is actually in possession of the photocard full licence once sent from DVLA.

Once actually in his possession he is then able to use this to supervise or use it to act as a provisional for other groups which a provisional/pass cert combo does not permit.
