Stemo pointed you to the correct advice - and you either didn't read it, or ignored it. Instead you took the incorrect advice of several others here and ignored the ticket and now you're half way to being shafted.

FFS - read and understand the MoneysavingExpert (or Pepipoo) advice, and open a post/case there.

If you've now missed the appeals deadline you have lost your trump card at defeating this. If you continue with your current gung-ho attitude you may as well pay up now because you WILL lose the case later at MUCH higher costs. Evidence doesn't matter much in these cases - it's decided under civil rules - balance of probability, and you end up having to prove you are innocent, not them prove you were guilty.

DO NOT contact ANYONE except MSE/Pepipoo until you know what you're doing. If you end up 'accidentally' admitting you were the driver you'll make your task even more difficult than it is at the moment.

To add to that thread.

If it is deemed that they were operating on council land illegally then you could also argue that they have had unauthorised access to your personal information as they knowingly did not have legitimate grounds to have access to it in the first place (giving further clout to another ban on access, hopefully indefinitely this time)  This is in breach of your right to a private life which is enshrined in the EHRC and mutually supported by the DPA.  You could possibly bring a complaint against the DVLA as well, as they disclosed the information without the necessary proof of legitimate grounds for access.  I would certainly ask them for proof of the steps they took to ascertain that there were reasonable grounds for disclosure (check the DVLA site for details on what that entails)

IMO the DVLA operates very close to the wind on the DPA and when the GDPR comes in it will be very interesting to see how it changes it's modus operandi WRT 3rd party access to our personal information.

Should you decide to write to them (based on what you say and have/photo evidence , there is no case, no claim so no need to write, just ignore), then add a confirmation that you are charging them £25 to cover your time and expense of notifying them to drop their illicit claim , and that you have no intention of paying, and should they continue to write/threaten you, then you will charge them an additional £25 henceforward for each and every one of your written replies.This should do the trick. I never return telephone calls from such people , as they are usually a waste of your time/money . One letter detailing your charges is more effective , they will no doubt decide to pick on some other unfortunate instead.

I have used this technique with various people and agencies over the years, and also last month with my previous broadband provider who thought they could charge me £75 broadband retrospective equipment charges - they have now dropped that claim, have also given me a refund of advance rental charges, and I am awaiting £75 costs from them for the time/3 letters I wrote making them aware of their illicit and erroneous claims for payment.

My wife says that as a pensioner I have too much time on my hands, that may be so but a person who works for free is always in work, and should you not place a value on your time, then generally nobody else will :)

The only thing I don`t have for my benefit is a photo of where the car was, and this is what will hinder me if I want to take the fight to them.

I already have done  :y

But as my car wasn`t on their private area I`d be surprised if they`re stupid enough to send my a photo of my car on a public highway, but we shall see  ;D

Basically, if they don't send a picture....its your word against theirs. So, it depends who believes who in a court :( If a picture is later provided to a court, which shows your car on the public highway, the case is lost for them (plus all the other problems they will incur through illegal activity).

They can't prove it, you can't disprove it. Car was not clamped, or removed. Its not like an ANPR Car Park, where there is photographic evidence.

Yeah I shot myself in the foot not getting a photo but I wasn`t in the frame of mind at the time, just have to wait and see what their next move is, fingers crossed they send a photo  ;)

Harsh maybe, but it appears to have got you to 'do the right thing'.

The advice on motoring/parking 'issues' available on Pepipoo or MSE is much more reliable than the majority of suggestions on here. People saying others should ignore parking tickets get on my t1ts.

Another update, UKCPS were stupid enough to send me some evidence of my car ticketed on publicly maintained land, and some great help from York City Council who have actually contacted UKCPS where I was parked was out of their boundaries.

My last e-mail from YCC said UKCPS were going to confirm in writing that the charge has been dropped but I`ve not had anything yet, but now the boot may be on the other foot.

It seems that by getting my details from the DVLA when they had no right to do so is seen as misuse of personal data and according to one of the guys on Pepipoo  misuse of personal data is a tort as confirmed in a couple of court cases and he suggests I should actually instigate a claim against them for the sum of £750 as this is seen as a reasonable amount for the misuse of personal data, stress and harassment.

Has anyone got any good information on going down this route?

I will also be sending e-mails to the DVLA, trading standards and the local paper just to help add a bit more hassle to UKCPS.
