Insurance claim advice...

Bike is now in the garage, will be estimated as to how much the repair costs will be...

Originally the parents were going to pay for it, as they reversed into it pushing it through a brick wall...  There now getting all arsey saying I should pay for it, and why should they...

So, going to claim on there insurance via mne...

Do I just ring up Bennetts and say what happened, and see how it goes??  Any other advice as to what I should do or need to do?

I'll know in a few days about repair cost estimates (bike is already at an insurance-approved centre)

It could be difficult to prove if they don't admit liability :(

Knowing how arsey most insurance companies are about paying out, don't be too suprised if thay say that as it was on private property and not on the highway. you will have to claim on your parents Household insurance!

If they don't admit liability, I'll kick the bloody side of there own car in and not claim liability for that one myself...  tis how annoyed I am right now  >:(

Seems a bit silly, you and them both getting a claim on your records over something like this. Any idea in what ballpark the claim will be?

No idea yet kevin, but I'm not expecting it to be cheap...

Bike has a distinct smell of petrol, the tank has a dent in the side and seems to have 'shifted' over, the fuel cut of valve switch is pushed in, front wheel is buckled and slightly out of line from the handle bars, front light is off centre...  The steering lock was on at the time, and is now broke (its actually welded to the front section of the frame too in the factory, god knows how this gets repaired...)

thats just what I've noticed...

As I said at the time, any bend in frame is a write off.  Judging by the damage, I'd be surprised if its not bent...

Are you seriously saying your parents wrecked your bike and now refuse to pay for it.

Mate get the insurance claimed against them....dont wish to disrespectful about your parents but they sounds heartless...couldnt ever imagine mine ever doing that. :o

Oh and if you still live at home....move out.!

Hmm...reguardless of the details, as with any claim first thing you need is a witness, failing that photo graphic evidence at the time, and failling that reconstruction at a later date. Photos/video what ever you've got, to prove your case.
You can put this through as a claim on your insurance,(some risk of loosing any claims bonus) you can deal direct with thier ins(they could claim off your ins.) Or as i think i would do. Find a third party claim company specialising in motor claims. Pages of M.C.N. are full of em. (didnt i see a solicitor on here?) the reason i mention 3 rd party company is most ins. companys these days are so busy getting business in, they cant deal with what they have got, hence your claim is likely to get lost, delayed and generally opps ed up (As the last 3 of myn where with direct line.) third party will pursue your claim like a dog with 2 dicks, its in their interest. Ring a third party company they will ask you the details and decide if there is a chance of winning, and making a few quid. ( you should not pay a bean for the claim esp. if you are successfull) if they take your case sit back and wait. If not i would speak to your own ins. co. But you sound like you have a cast iron case to me. Hope helps.

Alright Peoples, stand aside and make way for the ex-claims manager.  Right now, [rolls up sleeves..  lol]:

1) Neither Jonny who was driving the car or his parents are obligated to repair your bike for you; however they are obligated to reimburse you the cost of repairs or compensate you to the value of the bike if it's beyond economic repair.  Alternatively, they may be "indemnified" by an insurance company if there was a policy in force that covers the accident (I'm having to guess that there is, as I don't know the circumstances of the accident).

2) If they will be allowing their insurers to deal with your claim, then they are obligated by the terms of their policy to not admit liability - doesn't mean they're not to blame, simply means that as they won't be dipping into their pockets for you, they don't have the right to go around saying "yes, it was us, we'll pay you" - if they want the insurers to pay then the insurers want them to keep their mouths shut and not (metaphorically) write cheques that the insurer then has to honour.

3)  If you claim off their insurance then you can do it in 1 of 2 different ways: claim off your policy first and your insurers will get their money back off their insurers; you'll probably have to pay an excess, which your insurer MAY get back for you at the same time they get reimbursed, or it may have to be claimed back separately.  Alternatively you can claim directly off Jonny/his parents insurance, although, again, they aren't obligated to do anything until you've suffered a financial loss, e.g. organised the repairs yourself and paid the bill - they don't have to organise the repairs for you if they don't want to.  Some insurers would prefer 3rd parties come to them direct, as it keeps costs lower and they know they aren't getting ripped off with inflated labour charges or costs for hire vehicles, others (the stupider ones) will tell you you're not their customer so they aren't going to help organise repairs; just send them proof of how much it cost.

4) Witnesses need to be idependent, i.e. not someone from your house, Johnny's house or in his vehicle etc.  Any non-independent witness carries no weight whatsoever.

5) Lastly, again I don't know what happened in the accident or where, but private property or public road makes no difference as this is a civil matter.  The only difference it could make is that if it happened on private property then it could have been the case that the car wasn't insured as he didn't legally need to be, but as there does seem to be an insurance company involced, that's not the case.
