Samsung now added to the tossers list
« on: 20 September 2008, 19:50:30 »

rather TV fault reoccured after Newent, as it seems to after lack of use, so rang them up, said they had repaired it twice, and had replaced the 2 parts that can cause the fault according to their repair agents, and I'd be looking for a replacement set.

They said that sounded reasonable, but they would have to get report from repair agents, which takes 5 days. They will call me back.

As it is being a right bitch today, thought I would chase it up.  No report has been requested, but if I wanted it fixed, I need to post them a copy of the receipt as they think the warranty may be up (its not yet).  When I explained I didn't what it fixed, but replaced, I had to speak to some dozy bint in escalations, who absolutely stonewalled me with "we will keep repairing the set whilst its in warranty, we will not replace."

TV was bought on 15th October, so if the next repair does not fix it, chances are it will be out of warranty, what happens then? "The TV will be out of warranty, but we can arrange a service engineer to look at it sir, and can then quote a repair cost".

I find this unacceptable.

Trouble is the tosspots I bought it from, Beyond Television, say that all warranty issues are to do with Samsung, so if Samsung want to repair again, thats the route I have to take, and Samsung say if I want replacement set, thats down to retailer.

It seems to me TB that the television was "not of merchantile quality when sold" under the Sale of Goods Act 1979, and on that basis you can request its replacement by writing to the Manufacturers, Samsung, stating that fact and listing the faults / repairs to date, along with declaring that you have allowed them all reasonable time to correct an obviously faulty product and under your rights contained within the Consumer Protection Act you demand its replacement forthwith. However this is now not an easy process as you have 'accepted ' the goods:

http://www.bbc.co.uk/consumer/guides_to/law_goods.shtml

and you will have to fight your corner!

If this fails to bring the desired replacement, consult with your local Trading Standards Department. ;)

Yes, trouble seems to be my contract is with Beyond Television, but they subcontract all warranty back to manufacturer (common these days).  Trouble is, Beyond Television will only act if Samsung say so, and Samsung will only say they will keep repairing (or attempting to) until the warranty expires.

Back when it first went wrong, TS, CAB, Retra (Beyond TV's trading association) all said that is not of satisfactory quality, I should get a refund, but Samsung simply would not authorise this, and Beyond TV's MD said all warranty decisions were with Samsung.

Please note my further edited comments in m,y earlier thread after considering your situation more deeply.

If you have declared your dissatisfaction previously, in writing, then it is vital you report this fact to Samsung and Trading Standards. ;)

Seems to me that as your contract is with Beyond Television it is down to THEM to provide a merchantable, working, TV system. What happens between them and Samsung is just that ...... between them and Samsung. Not your problem.

My Samsung fridge freezer [  failed due to one of the fans becoming ice bound - the auto defrost bit wasn't performing properly. It was out of warranty, but as Samsung knew there was a problem with them, they'd extended the warranty by a year (or 2? :-/) and sent someone out to repair it.
