No Di, the repair is £1882 as quoted by BMW for a door, I can get the stuff for £1200 then get the rest of the stuff for the rest of the amount. Not try and get £1882 out of them, they're paying out £1882 not £1200.

I totally agree with you there Del, And I would be really gutted as well, and have been in the past when had cars totalled by uninsured drivers, A long time ago I had 13 cars on a saturday morning, by the time I went  to bed early hours of Sunday I had 6 left. 7 totalled in less than 24 hours, my insurance went up to 14k a year.

Hmm... I think you've got the wrong end of the stick Di... He's just looking to get the repair done at his choice of repairer (which everyone is entitled to do) who happens to be able to do the extras for the same price as BMW want for a basic repair.

This is not comparable to your situation which you referred to ;)

Afraid you're jumping up and down about nothing... Perhaps you've had a bad day ;)

Not had a bad day, quite the contrary, but if he can get it done at a reputeable repairer for £1200 get it done. And that should be the end of it. He is trying to wangle the extra £600 for they toys and that in my eyes is not fair, to anyone who insures a car, people doing these things increase premiums for us all, including himself.
Oh and by the way, there is a way of doing it, and is quite simple really. ;) ;) ;) ;) ;) ;)

I said I can get the extras for £1200 not get the door done for £1200. I'm not trying to wangle anything because either way they'll be paying £1882. So explain how that is wangling when they'll be paying that amount to BMW if I don't get the cash?

In that case LD, would Del not only be entitled to claim - or the insurance only be required to pay out - for the actual cost of repair?  In the case of his garage of choice - £1200.

The garage never said £1200 for the repair, they'll have to order a door from BMW thus adding postage onto the £1882 so it'd be more wouldn't it? What I said was the extras could be got for £1200. LD actually summed everything up perfectly in his post.

what are you talking about - your car needs repairing, the insurance company will pay for this repair, you have the right to decide where you want the work done but if it is not at their approved bodyshop then the assesor will want to see your car.
the only way to get what you want is for your garage to fraudulently claim by bumping up the price :-? ::)

So to conclude.

Who ever does the repair the other guys insurance will be paying for it, this in turn will be checked by an accesor from Admiral and if deemed Del has fitted upgraded parts whilst the repair carried place they will be asking him for the difference.

Why?

Because no matter if Dell can get get the job done £1200 to cover the parts, the insurance are only liable for the repair on a like for like basis, so it doesnt matter if the total is £4k for the repair or £2K at Bodge it and Scarper, they will only pay for the repair, simple as.

you can ask for a settlement by cheque Del, but your insurer may want to send their guy to examine the damage and he may decide it can be repaired cheaper (altho being a Beemer, it'll be classed as a premium brand(most beemers,mercs, audis etc are) and you can insist the work be priced for a BMW garage to repair it)  :y

ps - use legal to claim back the excess you'll need to fork out to the garage

as an aside - Del's insurer pays then claims back from the Lexus guys insurance company (assuming he's insured - if not...chase them with legal or the claim goes against you - "at fault" doesnt mean you're at fault, it simply means that your insurer is out of pocket....until they get their money from Lexus guys insurer or you its an at fault claim on your policy  :()

As I understand it Del the cost of fitting the new original equipment door by BMW (even though it may not be fitted by a BMW service centre) is £1882.

If your insurance company has agreed to that figure, they may want to see the repair done in full to justify their payout in order to prevent your doing what you're suggesting and having the repair done for a lesser amount and using the difference to spend on other work.

Although they may deal with the garage directly or through you, on foot of an invoice produced - you may have inadvertently declared your intentions to them, on this post, of seeking the agreed larger amount whilst attempting to spend less on the repair to enable you to use the difference in other ways.

They may not necessarily think that this was a good deal for them. :-/

Skruntie my insurance is Autonet or something like that, don't know anyone that works there to be honest.
