Urgent advice needed please...
« on: 01 March 2008, 17:44:27 »

as some of you are aware i sold my old passat on ebay,
http://cgi.ebay.co.uk/ws/eBayISAPI.dll?ViewItem&rd=1&item=300200396886&ssPageName=STRK:MESO:IT&ih=020

The guy came form essex to collect it today, This guy is a mechanic and bought it with a view to fix the probs and sell it on and make some money. He has just phoned me to say it has broken down on the M6 and a piston has shot thru the block, now this car had a sticking valve, is this likely to happen on what i called a tappety engine, the guy had a good look around  the engine before paying, as you would, checked the usual thing, oil cap, where he found white froth and announced the head gasket was gone, but he would sort that when he sorts the valve, didnt seem phased by it, looked all around the car and went to the cash  point to get his money, altho this guy won it on ebay auction if he wanted to back out after viewing i would have agreed, but did not make this common knowledge i thought i would leave that ball in his court. He paid and off he went , seemed happy enough, then the call!!, all i could suggest is that he phoned the AA. What more could i do, heat the end of the day he has bought a car with engine problems from a
private seller. What come back am i likely to have from this, i gave him a reciept that stated sold as seen, no waranty or garantee's given.

If i am right, there is nothing he can do. he might log a complaint with ebay but as you said it was sold as seen and he knew that the head gasket had goneas he told you! so i wouldnt worry to much about it.
have you got a copy fo the receipt you gave him for your records, its just going to cost him a bit more to fix it now thats all.

He has no comeback AT ALL

It was sold as seen, with a known / described fault.

It was his risk to drive a car with a faulty valve, he should have trailered it.

The receipt will help I'm sure.  AFAIK trading standards only apply to trade sales, so no comeback but that doesn't mean he won't try.

Rod doesn't go through block from head gasket or tappety engine that I've heard of.  :-/

First off what the breaks he doing trying to drive a car back to Essex from Blackpool with a blown h.g?  :o second its sold as seen buyer beware, and lastly you are not at liberty to point out faults but if you are asked about them then you must answer truthfully.
Summary he has no grounds for redress whatsowever
