Sold my astra at the weekend

on Saturday i washed my  old astra and put a for sale sign on it as i wanted it off the drive 
5 minutes later a man bought the car and drove it away.

I got a call this morning from the guy saying that the car was knackered as there was something wrong withthe imobiliser  he told me he would be handing the keys in to me  i was to refund his money and go and collect the car myself (some 45 miles away)

It was a y reg astra estate  1.7 dti sold in good faith for £500 MOT till mid oct taxed till march I told him all the issues  i knew about  and he drove away happy.


Can someone confirm i dont have to refund him anything legaly as it was sold as seen?

I have offered to refund him the money provided he returns the car to me he seems to think its my problem  and ive to fix it.

anyone got any input on this?

did you provide a receipt with a duplicate copy for yourself, stating sold as seen and no warranty implied?

can he obtain proof the immobiliser has a problem?

No
All that changed hands was keys money and the 2 parts of the v5 were completed etc

IMHO, it's his problem. Private car sale. Caveat emptor. He should have done his homework before handing over the cash.

It would have been better if you'd had a receipt indicating it was sold as seen, etc.. but I don't believe you are in any way obliged to appease him, especially not at your expense.

Scam written all over it.

You give the cash, receive the keys, go to the car.....which is no longer there, or stripped of parts, or crashed, or used in robbery etc etc etc

youve no money and no car.

Say no, and threaten with police

if he wont bring you the car exactly how you sold it to him, he doesn't get a penny back!

Yep, goes without saying that the car has to be back in possession, and intact, before handing over readies if you are going to accept it back.

You have the law on your side. There's no obligation for you to provide a warranty. Doesn't help when he's kicking your door in, I appreciate, but a call to the old bill or the local rugby club ought to resolve that.

Private sales;
All sales are final unless an agreement had been established. Did you give him adequate time to asess the vehicle? If he didn't take long to look at it, that's his fault, but as long as you didn't rush him that's something we need to satisfy.
You are under no duty (legally) to offer anything now, even though the defect has ocurred after a 'short time' from initial purchase.
Rules for trade sales are not relevant, but differ somewhat.
