Title: A legal question.
Post by: Tetleysmooth on 27 March 2012, 17:36:16
Ok, I'd like to buy an Elite which is for sale in the classifieds on here, the thing is, it doesn't have any tax or mot. I've often heard people say 'Book it in for an mot, and drive it to the mot station'.
The thing is, the car is in Northants, and my mot station is in Rainham, Essex. Now, I'm sure if I was stopped by the police, I don't think they'd really swallow that, but I could be wrong. Does anyone know for sure what the rules are? Can you drive an un-mot'd car any distance as long as you are driving it to a pre booked mot?

Pretty sure it has to be the nearest test station, Northants to Essex might be stretching it a bit  ;D

Well, that possibly puts the lid on that then, unless there's someone on here that does cheap transportation  :)

Wow, when did that law change ? I thought as long as car was insured and pre booked with an MOT test station that had written down the number plate in there books it was ok to drive it. Especially as can't get tax without an MOT.

I must really be behind the times  :-[

Well I've just driven to the station & returned with an MOT without tax. How else are you supposed to get tax :-\ ???

Tax isn't the problem it's not having an mot..it makes whatever insurance you have invalid. (6 points I think + they will impound the car)

You can drive a car home you have just bought with no tax because when you get it home and tax it it is back dated to the first of the month.

No MOT is up to £1000 with no penalty points.
No Insurance is up to £5000. 6 to 8 points.

The 'drive it home to tax it' bit doesn't sound right to me.  :-\

From the DVLA web site ..

Quote
Driving an untaxed vehicle to an MOT test

You can drive your vehicle to and from a pre-arranged test at an MOT test station as long as you have adequate insurance cover.

This also applies to vehicles being driven to and from a pre-arranged test at:

a Vehicle Inspection Check (VIC) test station
an approved weight testing station and reduced pollution test station

It is also easy to arrange insurance for an untaxed/unMOTed vehicle for the purpose of driving to and from the test ... you just phone your insurer and TALK    ........   :)

That's right.

you CAN drive to and return from a pre-arranged MOT test without tax or MOT.

there is no specified distance for this.

nevertheless, the car must be insured.

If you can get the prop disconnected I'll be more than happy to tow it back for you on the A frame Dave.

I tried the pre-booked MOT line and didnt get away with it.  Mind you I was driving from north Wales to SE London!   ;D

If its not taxed and tested it can't be towed with its wheels on the road :y

i use to just hire a trailer and a Transit round our way for about a 100 quid. Normally cheaper than arranging collection. Or is there not a forum member local to the car who can store it while you arrange a MOT local to the car and willing for you to carry out the work needed at their place?

Maybe not, but I'd reckon most coppers with any common sense about them will ignore a car that's being towed & not driven on the road.  :y

Cheers Day.
That's a bloomin' good offer mate.
Mulling all options over at the moment. It may make more sense just to keep the 2 litre CD  ;D

When sat behind the wheel of the towed vehicle and in control of the steering and brakes then, yes.  :)

You could always book into a series of MOT stations along the route home, not a popular option but it is workable if you get stopped you name the nearest one you are booked into, as to the moral value of this :-X

I suppose I could book it into - or ask the seller to book it into a garage near to where the car is. I could insure it for a day. But then there's the question of tax. If it passed I still couldn't drive it home without risk. If the car failed the mot, I'd be completely screwed.

Ask the seller to MOT it at your expense ;)

Hmmmm. D'you know Pete, I never thought of that.
Thing is, that would make the car worth a tad more.
I'd certainly ask more for a car with 12 months test on it.

I'd take the chance on the tax. After all you've just picked it up. If once you get it home you tax it I'm sure your be ok. I remember walking out of the post office and finding a copper stood next to my untaxed car. He ripped in to me like a loon. So I let him get it off his chest and when he paused for air (honestly you would of though I was murderer the way he went off on one) I just held up the tax disc I'd just been in the post office to buy. He turned round and fooked off. No apology nothing. Silly nana

That's what I did with the Jag - it had MOT left to run but no tax, I asked the seller to tax it for me (I sent him a copy of my insurance cert) and viola, legal drive home :y

If the copper had wanted to be funny he could have booked you for not displaying a current tax disc ::)
